AN ACT to amend the public officers law and the town law, in relation to
the residence of the person holding the office of town superintendent
of highways or town engineer of the town of Pavilion, Genesee county
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 3 of the public officers law is amended by adding a
2 new subdivision 68 to read as follows:
3 68. In the town of Pavilion, Genesee county, the provisions of this
4 section requiring a person to be a resident of the political subdivision
5 or municipal corporation of the state for which he or she shall be
6 chosen, or within which his or her official functions are required to be
7 exercised, shall not prevent a person from holding the office of town
8 superintendent of highways or town engineer of the town of Pavilion,
9 provided that such person resides in an adjoining town or village within
10 an adjoining town within the state of New York. Provided, however, the
11 person performing the functions of town superintendent of highways or
12 town engineer in any other town shall be a resident of such town, unless
13 otherwise provided by law.
14 § 2. Section 23 of the town law is amended by adding a new subdivision
15 33 to read as follows:
16 33. Notwithstanding subdivision one of this section, in the town of
17 Pavilion, Genesee county, the person performing the function of town
18 superintendent of highways or town engineer need not be an elector of
19 such town, provided that such person is an elector in an adjoining town
20 or village within an adjoining town within the state. Provided, however,
21 the person performing the function of town superintendent of highways or
22 town engineer in any other town shall be an elector of such town, unless
23 otherwise provided by an act of the state legislature.
24 § 3. This act shall take effect immediately.
