Establishes the crime of criminal sale of an internet domain name to a terrorist group or organization listed by the office of homeland security as posing a terrorist threat, a class A misdemeanor.

AN ACT to amend the penal law and the executive law, in relation to
establishing the crime of criminal sale of an internet domain name to
a terrorist group
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The penal law is amended by adding a new section 490.60 to
2 read as follows:
3 § 490.60 Criminal sale of an internet domain name to a terrorist group.
4 A person is guilty of criminal sale of an internet domain name to a
5 terrorist group when he or she knowingly sells or provides without
6 charge an internet domain name to any organization included on the list
7 of organizations engaged in terrorist activities or who pose a terrorist
8 threat compiled, maintained and updated by the state office of homeland
9 security pursuant to paragraph (t) of subdivision two of section seven
10 hundred nine of the executive law.
11 Criminal sale of an internet domain name to a terrorist group is a
12 class A misdemeanor.
13 § 2. Paragraphs (q), (r) and (r) of subdivision 2 of section 709 of
14 the executive law, paragraph (q) as separately amended by chapters 537
15 and 620 of the laws of 2005, paragraph (r) as added by chapter 537 of
16 the laws of 2005 and paragraph (r) as added by chapter 620 of the laws
17 of 2005, are amended, and a new paragraph (t) is added to read as
18 follows:
19 (q) request from any department, division, office, commission or other
20 agency of the state or any political subdivision thereof, and the same
21 are authorized to provide, such assistance, services and data as may be
22 required by the office of homeland security in carrying out the purposes

1 of this article, subject to applicable laws, rules, and regulations;
2 [and]
3 (r) develop standards and a certification process for training
4 programs for training of private security officers in commercial build-
5 ings which shall:
6 (i) improve observation, detection and reporting skills;
7 (ii) improve coordination with local police, fire and emergency
8 services;
9 (iii) provide and improve skills in working with advanced security
10 technology including surveillance and access control procedures;
11 (iv) require at least forty hours of training including three hours of
12 training devoted to terrorism awareness; and
13 (v) have been certified as a qualified program by the state office of
14 homeland security[.
15 (r)];
16 (s) work in consultation with or make recommendations to the commis-
17 sioner of agriculture and markets in developing rules and regulations
18 relating to ammonium nitrate security[.]; and
19 (t) compile, maintain and periodically update a list of organizations
20 engaged in terrorist activities or who pose a terrorist threat and make
21 such list available to the public.
22 § 3. This act shall take effect on the first of November next succeed-
23 ing the date on which it shall have become a law.
