Relates to financing by and through the dormitory authority for the Reece School, the Reece School shall have full power and authority to assign and pledge to the dormitory authority, any and all public funds in an amount sufficient to make all payments required to be made by the Reece School to any lease, sublease or other agreement entered into between the Reece School and the dormitory authority.

AN ACT to amend the public authorities law, in relation to financing by
and through the dormitory authority for the Reece School; and to amend
chapter 698 of the laws of 1991 amending the public authorities law
and the education law, relating to the construction and financing of
facilities by the dormitory authority for private schools approved
pursuant to article 89 of the education law, in relation to including
the Reece School, New York
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The undesignated paragraph of paragraph (b) of subdivision
2 2 of section 1676 of the public authorities law, as added by chapter 465
3 of the laws of 2009, is amended to read as follows:
4 The Reece School, for the financing or refinancing, or reimbursement
5 of the costs of, the acquisition, design, construction, reconstruction,
6 rehabilitation, improvement, furnishing and equipping of, or otherwise
7 providing for, additional floors or facilities for education and therapy
8 at their facility located at twenty-five East One Hundred Fourth Street
9 in the city of New York, to serve as a school for special education
10 students; provided, however, that the aggregate sum of any bonds issued
11 for such purpose shall not exceed [twenty] thirty-five million dollars.
12 Notwithstanding any other provision of law, the Reece School shall have
13 full power and authority to assign and pledge to the dormitory authori-
14 ty, any and all public funds to be apportioned or otherwise made payable
15 by the United States, any agency thereof, the state, any agency thereof,
16 a political subdivision, as defined in section one hundred of the gener-
17 al municipal law, any social services district in the state or any other

1 governmental entity in an amount sufficient to make all payments
2 required to be made by the Reece School to any lease, sublease or other
3 agreement entered into between the Reece School and the dormitory
4 authority. All state and local officers are hereby authorized and
5 required to pay all such funds so assigned and pledged to the dormitory
6 authority or, upon the direction of the dormitory authority, to any
7 trustee of any dormitory authority bond or note issued, pursuant to a
8 certificate filed with any such state or local officer by the dormitory
9 authority pursuant to the provisions of this section.
10 § 2. The undesignated paragraph of subdivision 1 of section 1680 of
11 the public authorities law, as added by chapter 465 of the laws of 2009,
12 is amended to read as follows:
13 The Reece School, for the financing or refinancing, or reimbursement

36 § 3. Section 7 of chapter 698 of the laws of 1991 amending the public
37 authorities law and the education law, relating to the construction and
38 financing of facilities by the dormitory authority for private schools
39 approved pursuant to article 89 of the education law, as separately
40 amended by chapters 28 and 471 of the laws of 2006, is amended to read
41 as follows:
42 § 7. The following private not-for-profit schools shall be eligible
43 private not-for-profit schools for purposes of title 4 of article 8 of
44 the public authorities law and, with respect to them, for the purposes
45 of article 15-A of the executive law only, the dormitory authority shall
46 be deemed a state agency as the term is used in such article, and its
47 contracts for design, construction, services and materials shall be
48 deemed state contracts within the meaning of that term as set forth in
49 such article:
