AN ACT to amend the education law, in relation to a course of study in
awareness and prevention of child sexual abuse for special needs chil-
dren
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The education law is amended by adding a new section 803-b
2 to read as follows:
3 § 803-b. Course of study in awareness and prevention of child sexual
4 abuse for children with special needs. 1. All pupils with special needs
5 in New York state shall receive instruction designed to promote aware-
6 ness and prevent child sexual exploitation and child sexual abuse of
7 children with special needs. Such program shall be taught in community
8 schools, specialized school districts, district seventy-five schools in
9 the city of New York, hospital setting schools, and any other school
10 where students with special needs are receiving services. Such program
11 shall be defined by the commissioner in regulations after consultation
12 with the department of health and be designed to specifically teach
13 students with special needs about the prevention of child sexual exploi-
14 tation and child sexual abuse in grades kindergarten through eight. Such
15 instruction shall include teaching methods designed for children with
16 special needs including, but not limited to, learning disabilities,
17 autism spectrum disorder, intellectual disabilities, and traumatic brain
18 injuries.
19 2. All alternative and augmented communication devices issued to
20 students in New York state shall contain a reporting tool for child
21 sexual exploitation and child sexual abuse. Students with limited commu-
22 nication skills who are issued alternative and augmented communication
23 devices shall be taught how to use such reporting tool, and the proper
24 situations warranting the use of such reporting tool.
25 § 2. This act shall take effect immediately.
