AN ACT to amend the village law, in relation to volunteer fire companies
in certain counties
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 10-1004 of the village law is amended to read as
2 follows:
3 § 10-1004 Organization of companies. 1. The board of fire commission-
4 ers, with the approval of the board of trustees, may organize and main-
5 tain fire, hose, protective and hook and ladder companies, whenever in
6 its judgment the public interests require. The board of fire commission-
7 ers may, by resolution, with the approval of the board of trustees,
8 consent to the incorporation of any of the companies so organized by
9 them, or may, by like approval, consent to the incorporation or the
10 organization without incorporation of as many companies voluntarily
11 organized in said village as may be deemed necessary.
12 2. (a) A village fire, hose, protective or hook and ladder company
13 located in any county having a population of more than two hundred
14 sixteen thousand but less than two hundred nineteen thousand may, with-
15 out the consent of the village board of trustees or the village board of
16 fire commissioners, enter into a contract to provide services to a town
17 in which the village is located provided that:
18 (i) the services to be provided shall be limited to fire protection,
19 general ambulance service, or emergency services in the case of acci-
20 dents, calamities or other emergencies, or any combination thereof; and
21 (ii) such contract shall be an extension or renewal of an existing
22 contract for such services in the town.
23 (b) The village board of trustees may not abolish a fire, hose,
24 protective or hook and ladder company pursuant to section 10-1020 of
25 this article based in whole or in part on the decision by such company
26 to enter into such a contract extension or renewal.
27 § 2. This act shall take effect immediately.
