Go to top STATE OF NEW YORK ________________________________________________________________________ 8312 2023-2024 Regular Sessions IN ASSEMBLY November 27, 2023 ___________ Introduced by M. of A. SAYEGH -- read once and referred to the Committee on Governmental Employees AN ACT to amend the civil service law, in relation to providing for school district employees who have been provisionally appointed to a position for at least nine months without an exam being offered for such position to receive a permanent appointment in such position The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 65 of the civil service law is amended by adding a 2 new subdivision 7 to read as follows: 3 7. Provisional appointments within school districts. Notwithstanding 4 any inconsistent provision of this chapter or any other law or rule to 5 the contrary, where a school district has made a provisional appointment 6 to a position and no civil service examination for such position has 7 been conducted within nine months of such appointment, the provisional 8 appointment shall not expire under subdivision two of this section and 9 instead the provisional appointee shall be appointed to the position 10 permanently and shall be considered to have been appointed consistent 11 with section sixty-one of this title. 12 § 2.
