        Introduced by M. of A. BARRON -- read once and referred to the Committee
          on Codes
 
        AN  ACT to amend the penal law, in relation to recording acts of govern-
          mental administration
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1. The penal law is amended by adding a new section 195.18 to
     2  read as follows:
     3  § 195.18 Recording acts of governmental administration.
     4    The fact that a person takes a photograph or makes an audio  or  video
     5  recording  of a police officer, peace officer, medical emergency techni-
     6  cian or personnel, fireman or other public servant performing  an  offi-
     7  cial function, while the police officer, peace officer, medical emergen-
     8  cy  technician  or  personnel,  fireman  or other public servant is in a
     9  public place or the person taking the photograph or making the recording
    10  is in a place he or she has the right to be, does not constitute, in and
    11  of itself, a violation of the provisions of this title.
    12    § 2. This act shall take effect on the thirtieth day  after  it  shall
    13  have become a law.
