        AN ACT to amend the mental hygiene law,  in  relation  to  oversight  of
          substance abuse services in state prisons by the commissioner of alco-
          holism and substance abuse services

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Paragraph 2 of subdivision a of section 19.09 of the mental
     2  hygiene law is amended by adding two new subparagraphs (A)  and  (B)  to
     3  read as follows:
     4    (A) The commissioner shall conduct periodic reviews of substance abuse
     5  treatment   policies   and   programs  operated  by  the  department  of
     6  corrections and community supervision. The purpose of such reviews shall
     7  be to ensure that policies and programs employ evidence-based  and  best
     8  practices  and  comply with standards established by the commissioner to
     9  the fullest extent possible within a correctional setting.
    10    (B) Such reviews shall be conducted, at a minimum,  every  two  years,
    11  and  the  commissioner shall file a written report with the governor and
    12  the legislature summarizing the results and  setting  forth  recommenda-
    13  tions  deemed necessary by the commissioner for modifying, implementing,
    14  developing, or coordinating policies and programs in the  department  of
    15  corrections  and  community supervision. The first report shall be filed
    16  by the commissioner no later than January first, two thousand sixteen.
    17    § 2. This act shall take effect immediately.
