AN ACT relating to authorizing the Knox town board to establish certain
speed limits
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. 1. Notwithstanding the provisions of section sixteen
2 hundred twenty-two of the vehicle and traffic law, in lieu of making a
3 request of the department of transportation pursuant to such section,
4 the town board of the town of Knox in the county of Albany, with respect
5 to town highways which have been functionally classified by the depart-
6 ment of transportation as local roads on official functional classifica-
7 tion maps approved by the federal highway administration pursuant to
8 part 470.105 of title 23 of the code of federal regulations, as amended
9 from time to time, and which are outside of cities and villages, may by
10 local law, ordinance, order, rule or regulation:
11 (a) Establish maximum speed limits at which vehicles may proceed on or
12 along designated town highways lower than the fifty-five miles per hour
13 statutory maximum speed limit. No such limit shall be established at
14 less than twenty-five miles per hour, except that school speed limits
15 may be established at not less than fifteen miles per hour, for a
16 distance not to exceed one thousand three hundred twenty feet, on a
17 highway passing a school building, entrance or exit of a school abutting
18 on the highway.
19 (b) Establish maximum speed limits at which vehicles may proceed on or
20 along all such town highways lying within such towns or within desig-
21 nated areas of such towns lower than the fifty-five miles per hour stat-
22 utory maximum speed limit. No such speed limit applicable throughout
23 such towns or within designated areas of such towns shall be established
24 at less than thirty miles per hour.

1 2. No such speed limits shall be established except in accordance with
2 the engineering considerations and factors for speed limits set forth in
3 the New York state manual and specifications for a uniform system of
4 traffic control devices as such manual and specifications may be amended
5 from time to time, certified by a licensed professional engineer who
6 specializes in traffic operations.
7 3. For the purposes of this section, the term "New York state manual
8 and specifications for a uniform system of traffic control devices"
9 shall mean the national manual of uniform traffic control devices
10 promulgated by the federal highway administration pursuant to subpart
11 (f) of part 655 of title 23 of the code of federal regulations and the
12 New York state supplement adopted by the commissioner of transportation
13 pursuant to section sixteen hundred eighty of the vehicle and traffic
14 law, and the term "town highways" shall have the same meaning as such
15 term is defined by subdivision five of section three of the highway law.
16 4. Nothing contained in this act shall be deemed to alter the authori-
17 ty of the department of transportation to establish maximum speed limits
18 at the request of the town board of the town of Knox in the county of
19 Albany, with respect to all town highways within such towns outside of
20 cities and villages pursuant to subdivision one of this section,
21 provided that no maximum speed limits have been established by such town
22 boards pursuant to this act on any town highway functionally classified
23 as a local road within such towns.
24 § 2. This act shall take effect on the one hundred eightieth day after
25 it shall have become a law. Effective immediately, the department of
26 transportation is authorized to promulgate such rules and regulations as
27 are necessary for the implementation of this act on its effective date.
