AN ACT to amend the election law, in relation to providing for electron-
ic administration of examinations of election inspectors, poll clerks
and election coordinators
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivisions 1 and 3 of section 3-412 of the election law,
2 as amended by chapter 180 of the laws of 2005, are amended to read as
3 follows:
4 1. Each board of elections shall, at least once every year, conduct a
5 mandatory school for the instruction of election inspectors, poll clerks
6 and election coordinators. [They] Except as described in subdivision
7 three of this section, they shall be given written notice stating the
8 time and place at which such school or schools shall be held.
9 3. Election inspectors, poll clerks and election coordinators as
10 required by this section shall, upon their original designation[, and
11 every year thereafter,] complete a course of instruction[, and, before
12 certification, pass an examination thereon] which shall be offered both
13 electronically and in person. Before certification for their original
14 designation and every year thereafter election inspectors, poll clerks
15 and election coordinators shall pass an examination thereon which may be
16 administered electronically or in person. The state board of elections
17 shall supply each board of elections with instructional material to be
18 used in the preparation for such examinations and shall give each such
19 board of elections uniform directions for the conduct of such examina-
20 tions and notice requirements for electronic instruction and examina-
21 tions, which, it shall be the duty of the board to follow. Every such
22 board may utilize additional materials selected by it in the course of
23 instruction. No person taking such examination shall be permitted to
24 know the questions or answers in advance or be given access to the

1 answers during the examination. If such inspectors or clerks pass such
2 examination, the board of elections shall certify the designated
3 election inspector or poll clerk.
4 § 2. This act shall take effect on the ninetieth day after it shall
5 have become a law. Effective immediately, the addition, amendment and/or
6 repeal of any rule or regulation necessary for the implementation of
7 this act on its effective date are authorized to be made and completed
8 on or before such date.
