          on Transportation
 
        AN  ACT to amend the vehicle and traffic law, in relation to prohibiting
          certain devices which enhance a vehicle's capacity to emit soot, smoke
          or other particulate emissions
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section 1. Subdivision 1 of section 375 of the vehicle and traffic law
     2  is amended by adding a new paragraph (f) to read as follows:
     3    (f)  No  person  shall  retrofit  any  diesel-powered vehicle with any
     4  device, smoke stack, or other equipment  which  enhances  the  vehicle's
     5  capacity  to  emit soot, smoke, or other particulate emissions, or shall
     6  purposely release significant quantities of soot, smoke, or other parti-
     7  culate emissions into the air and onto roadways and other vehicles while
     8  operating the vehicle. Any such  violation  shall  be  punishable  as  a
     9  misdemeanor.
    10    § 2. This act shall take effect immediately.
