AN ACT to amend the executive law, in relation to a comprehensive plan
and operational guidelines to promote veteran-owned business enter-
prises
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The article heading of article 17-B of the executive law,
2 as added by chapter 22 of the laws of 2014, is amended to read as
3 follows:
4 PARTICIPATION BY [SERVICE-DISABLED] VETERANS WITH RESPECT TO
5 STATE CONTRACTS
6 § 2. Section 369-h of the executive law, as added by chapter 22 of the
7 laws of 2014, is amended to read as follows:
8 § 369-h. Definitions. As used in this article, the following terms
9 shall have the following meanings:
10 1. "Certified service-disabled veteran-owned business enterprise"
11 shall mean a business enterprise, including a sole proprietorship, part-
12 nership, limited liability company or corporation that is:
13 (a) at least fifty-one percent owned by one or more service-disabled
14 veterans;
15 (b) an enterprise in which such service-disabled veteran ownership is
16 real, substantial, and continuing;
17 (c) an enterprise in which such service-disabled veteran ownership has
18 and exercises the authority to control independently the day-to-day
19 business decisions of the enterprise;

1 (d) an enterprise authorized to do business in this state and is inde-
2 pendently-owned and operated;
3 (e) an enterprise that is a small business which has a significant
4 business presence in the state, not dominant in its field and employs,
5 based on its industry, a certain number of persons as determined by the
6 director, but not to exceed three hundred, taking into consideration
7 factors which include, but are not limited to, federal small business
8 administration standards pursuant to 13 CFR part 121 and any amendments
9 thereto; and
10 (f) certified by the office of general services.
11 2. "Certified veteran-owned business enterprise" shall mean a business
12 enterprise, including a sole proprietorship, partnership, limited
13 liability company or corporation that is:
14 (a) at least fifty-one percent owned by one or more veterans;
15 (b) an enterprise in which such veteran ownership is real, substan-
16 tial, and continuing;
17 (c) an enterprise in which such veteran ownership has and exercises
18 the authority to control independently the day-to-day business decisions
19 of the enterprise;
20 (d) an enterprise authorized to do business in this state and is inde-
21 pendently-owned and operated;
22 (e) an enterprise that is a small business which has a significant
23 business presence in the state, not dominant in its field and employs,
24 based on its industry, a certain number of persons as determined by the
25 director, but not to exceed three hundred, taking into consideration
26 factors which include, but are not limited to, federal small business
27 administration standards pursuant to 13 CFR part 121 and any amendments
28 thereto; and
29 (f) certified by the office of general services.
30 3. "Commissioner" shall mean the commissioner of the office of general
31 services.
32 [3.] 4. "Director" shall mean the director of the division of
33 [service-disabled] veterans' business development.
34 [4.] 5. "Division" shall mean the division of [service-disabled]
35 veterans' business development in the office of general services.
36 [5. "Service-disabled veteran" shall mean (a) in the case of the
37 United States army, navy, air force, marines, coast guard, army national
38 guard or air national guard and/or reserves thereof, a veteran who
39 received a compensation rating of ten percent or greater from the United
40 States department of veterans affairs or from the United States depart-
41 ment of defense because of a service-connected disability incurred in
42 the line of duty, and (b) in the case of the New York guard or the New
43 York naval militia and/or reserves thereof, a veteran who certifies,
44 pursuant to the rules and regulations promulgated by the director, to
45 having incurred an injury equivalent to a compensation rating of ten
46 percent or greater from the United States department of veterans affairs
47 or from the United States department of defense because of a service-
48 connected disability incurred in the line of duty.]
49 6. "State agency" shall mean: (a)(i) any state department; or (ii) any
50 division, board, commission or bureau of any state department; or (iii)
51 the state university of New York and the city university of New York,
52 including all their constituent units except community colleges and the
53 independent institutions operating statutory or contract colleges on
54 behalf of the state; or (iv) a board, a majority of whose members are
55 appointed by the governor or who serve by virtue of being state officers
56 or employees as defined in subparagraph (i), (ii) or (iii) of paragraph

1 (i) of subdivision one of section seventy-three of the public officers
2 law.
3 (b) a "state authority," as defined in subdivision one of section two
4 of the public authorities law, and the following:
5 Albany County Airport Authority;
6 Albany Port District Commission;
7 Alfred, Almond, Hornellsville Sewer Authority;
8 Battery Park City Authority;
9 Cayuga County Water and Sewer Authority;
10 (Nelson A. Rockefeller) Empire State Plaza Performing Arts Center
11 Corporation;
12 Industrial Exhibit Authority;
13 Livingston County Water and Sewer Authority;
14 Long Island Power Authority;
15 Long Island Rail Road;
16 Long Island Market Authority;
17 Manhattan and Bronx Surface Transit Operating Authority;
18 Metro-North Commuter Railroad;
19 Metropolitan Suburban Bus Authority;
20 Metropolitan Transportation Authority;
21 Natural Heritage Trust;
22 New York City Transit Authority;
23 New York Convention Center Operating Corporation;
24 New York State Bridge Authority;
25 New York State Olympic Regional Development Authority;
26 New York State Thruway Authority;
27 Niagara Falls Public Water Authority;
28 Niagara Falls Water Board;
29 Port of Oswego Authority;
30 Power Authority of the State of New York;
31 Roosevelt Island Operating Corporation;

39 Upper Mohawk valley regional water finance authority;
40 Upper Mohawk valley memorial auditorium authority;
41 Urban Development Corporation and its subsidiary corporations.
42 (c) the following only to the extent of state contracts entered into
43 for its own account or for the benefit of a state agency as defined in
44 paragraph (a) or (b) of this subdivision:
45 Dormitory Authority of the State of New York;
46 Facilities Development Corporation;
47 New York State Energy Research and Development Authority;
48 New York State Science and Technology Foundation.
49 (d) "state contract" shall mean: (i) a written agreement or purchase
50 order instrument, providing for a total expenditure in excess of twen-
51 ty-five thousand dollars, whereby a contracting agency is committed to
52 expend or does expend funds in return for labor, services including but
53 not limited to legal, financial and other professional services,
54 supplies, equipment, materials or any combination of the foregoing, to
55 be performed for, or rendered or furnished to the contracting agency;
56 (ii) a written agreement in excess of one hundred thousand dollars

1 whereby a contracting agency is committed to expend or does expend funds
2 for the acquisition, construction, demolition, replacement, major repair
3 or renovation of real property and improvements thereon; and (iii) a
4 written agreement in excess of one hundred thousand dollars whereby the
5 owner of a state assisted housing project is committed to expend or does
6 expend funds for the acquisition, construction, demolition, replacement,
7 major repair or renovation of real property and improvements thereon for
8 such project.
9 7. "Veteran" shall mean a person who served in and who has received an
10 honorable or general discharge from, the United States army, navy, air
11 force, marines, coast guard, and/or reserves thereof, and/or in the army
12 national guard, air national guard, New York guard and/or the New York
13 naval militia.
14 § 3. Section 369-i of the executive law, as added by chapter 22 of the
15 laws of 2014, is amended to read as follows:
16 § 369-i. Division of [service-disabled] veterans' business develop-
17 ment. 1. The head of the division of [service-disabled] veterans' busi-
18 ness development shall be the director who shall be appointed by the
19 governor and who shall hold office at the pleasure of the commissioner.
20 2. The director may appoint such deputies, assistants, and other
21 employees as may be needed for the performance of the duties prescribed
22 herein subject to the provisions of the civil service law and the rules
23 and regulations of the civil service commission. The director may
24 request and shall receive from any (i) department, division, board,
25 bureau, or executive commission of the state or (ii) state agency, such
26 assistance as may be necessary to carry out the provisions of this arti-
27 cle.
28 3. The director shall have the following powers and duties:
29 (a) Develop, collect, summarize and disseminate information that will
30 be helpful to persons and organizations throughout the state in under-
31 taking or promoting the establishment and successful operation of a
32 [service-disabled] veteran-owned business.
33 (b) Develop and make available to state agencies a directory of certi-
34 fied [service-disabled] veteran-owned business enterprises which shall,
35 wherever practicable, be divided into categories of labor, services,
36 supplies, equipment, materials and recognized construction trades and
37 which shall indicate areas or locations of the state where such enter-
38 prises are available to perform services. Such directory shall be posted
39 on the office of general services website.
40 (c) Assist state agencies in the development of programs to foster and
41 promote the use of [service-disabled] veteran-owned business enterprises
42 on state contracts.
43 (d) Coordinate the plans, programs and operations of the state govern-
44 ment which affect or may contribute to the establishment, preservation
45 and development of [service-disabled] veteran-owned business enter-
46 prises.
47 (e) To appoint independent hearing officers who by contract or terms
48 of employment shall preside over adjudicatory hearings pursuant to this
49 section for the office and who are assigned no other work by the office.
50 (f) In conjunction with the commissioner, develop a comprehensive
51 statewide plan and operational guidelines to promote [service-disabled]
52 veteran-owned business enterprises and to assist them in obtaining
53 opportunities to participate in the procurement of goods and services by
54 the state, including identification of barriers to [service-disabled]
55 veterans' business development and investigation and evaluation of their
56 impact on achieving the objectives of this article.

1 4. The commissioner shall:
2 (a) Coordinate training of all procurement personnel of state agen-
3 cies, emphasizing increased sensitivity and responsiveness to the unique
4 needs and requirements of [service-disabled] veteran-owned business
5 enterprises.
6 (b) Conduct a coordinated review of all existing and proposed state
7 training and technical assistance activities in direct support of the
8 [service-disabled] veterans' business development program to assure
9 consistency with the objectives of this article.
10 (c) Evaluate and assess availability of firms for the purpose of
11 increasing participation of such firms in state contracting in consulta-
12 tion with relevant state entities including, but not limited to, the New
13 York state division of veterans' affairs.
14 (d) Provide advice and technical assistance to promote [service-disa-
15 bled] veteran-owned business enterprises' understanding of state
16 procurement laws, practices and procedures to facilitate and increase
17 the participation of [service-disabled] veteran-owned business enter-
18 prises in state procurement.
19 (e) Establish regular performance reporting systems regarding imple-
20 mentation of the programs designed to increase [service-disabled] veter-
21 an-owned business participation in procurement contracts by state agen-
22 cies.
23 (f) Submit a report by the thirty-first of December each year, with
24 the first report due by the thirty-first of December in the calendar
25 year next succeeding the calendar year in which this article shall have
26 become a law, to the governor, the temporary president of the senate,
27 and the speaker of the assembly. Such report shall include information
28 including, but not limited to, the number of contracts entered into
29 pursuant to this article, the average amount of such contracts, the
30 number of [service-disabled] veteran-owned business enterprises certi-
31 fied, the number of applications for certification as a [service-disa-
32 bled] veteran-owned business enterprise, the number of denials for such
33 certification, the number of appeals of such denials, and the outcome of
34 such appeals and the average time that is required for such certif-
35 ication to be completed.
36 5. Certification. (a) The director, or in the absence of the director,
37 the commissioner, within ninety days of the effective date of this arti-
38 cle, shall promulgate rules and regulations providing for the establish-
39 ment of a statewide certification program including rules and regu-
40 lations governing the approval, denial, or revocation of any such
41 certification. Such rules and regulations shall include, but not be
42 limited to, such matters as may be required to ensure that the estab-
43 lished procedures thereunder shall at least be in compliance with the
44 code of fair procedure set forth in section seventy-three of the civil
45 rights law.
46 (b) The division of [service-disabled] veterans' business development
47 shall be responsible for verifying businesses as being owned, operated,
48 and controlled by a [service-disabled] veteran and for certifying such
49 verified businesses. Status as a [service-disabled] veteran pursuant to
50 paragraph (a) of this subdivision shall be documented by a copy of the
51 veteran's certificate of release or discharge from active duty, includ-
52 ing but not limited to, a DD-214 form or an honorable service
53 certificate/report of causality from the department of defense, a letter
54 of certification by the United States department of veterans affairs or
55 the United States department of defense and any additional information
56 that may be required by the division of [service-disabled] veterans'

1 business development. In the case of the New York guard or the New York
2 naval militia and/or reserves thereof, status as a [service-disabled]
3 veteran pursuant to this paragraph shall be documented pursuant to rules
4 and regulations promulgated by the director, or in the absence of the
5 director, the commissioner.
6 (c) Following application for certification pursuant to this section,
7 the director shall provide the applicant with written notice of the
8 status of the application, including notice of any outstanding deficien-
9 cies, within thirty days. Within sixty days of submission of a final
10 completed application, the director shall provide the applicant with
11 written notice of a determination by the director approving or denying
12 such certification and, in the event of a denial, a statement setting
13 forth the reasons for such denial. Upon a determination denying or
14 revoking certification, the business enterprise for which certification
15 has been so denied or revoked shall, upon written request made within
16 thirty days from receipt of notice of such determination, be entitled to
17 a hearing before an independent hearing officer designated for such
18 purpose by the director. In the event that a request for a hearing is
19 not made within such thirty day period, such determination shall be
20 deemed to be final. The independent hearing officer shall conduct a
21 hearing and upon the conclusion of such hearing, issue a written recom-
22 mendation to the director to affirm, reverse, or modify such determi-
23 nation of the director. Such written recommendation shall be issued to
24 the parties. The director, within thirty days, by order, must accept,
25 reject or modify such recommendation of the hearing officer and set
26 forth in writing the reason therefor. The director shall serve a copy of
27 such order and reasons therefor upon the business enterprise by personal
28 service or by certified mail return receipt requested. The order of the
29 director shall be subject to review pursuant to article seventy-eight of
30 the civil practice law and rules.
31 (d) All certifications shall be valid for a period of five years.
32 § 4. Section 369-j of the executive law, as added by chapter 22 of the
33 laws of 2014, is amended to read as follows:
34 § 369-j. Opportunities for certified [service-disabled] veteran-owned
35 business enterprises. 1. The director, or in the absence of the direc-
36 tor, the commissioner, within ninety days of the effective date of this
37 article shall promulgate rules and regulations for the following
38 purposes:
39 (a) provide measures and procedures to ensure that certified
40 [service-disabled] veteran-owned business enterprises are afforded the
41 opportunity for meaningful participation in the performance of state
42 contracts and to assist in state agencies' identification of those state
43 contracts for which certified [service-disabled] veteran-owned business
44 enterprises may best perform;
45 (b) provide for measures and procedures that assist state agencies in
46 the identification of state contracts where [service-disabled] veteran
47 contract goals are practical, feasible and appropriate for the purpose
48 of increasing the utilization of [service-disabled] veteran-owned busi-
49 ness enterprise participation on state contracts;
50 (c) achieve a statewide goal for participation on state contracts by
51 [service-disabled] veteran-owned business enterprises of six percent;
52 (d) provide for procedures relating to submission and receipt of
53 applications by [service-disabled] veteran-owned business enterprises
54 for certification;
55 (e) provide for the monitoring and compliance of state contracts by
56 state agencies with respect to the provisions of this article;

1 (f) provide for the requirement that state agencies submit regular
2 reports, as determined by the director, with respect to their [service-
3 disabled] veteran-owned business enterprise program activity, including
4 but not limited to, utilization reporting and state contract monitoring
5 and compliance;
6 (g) notwithstanding any provision of the state finance law, the public
7 buildings law, the highway law, the transportation law or the public
8 authorities law to the contrary, provide for the reservation or set-a-
9 side of certain procurements by state agencies in order to achieve the
10 objectives of this article; provided, however, that such procurements
11 shall remain subject to (i) priority of preferred sources pursuant to
12 sections one hundred sixty-two and one hundred sixty-three of the state
13 finance law; (ii) the approval of the comptroller of the state of New
14 York pursuant to section one hundred twelve and section one hundred
15 sixty-three of the state finance law and section twenty-eight hundred
16 seventy-nine-a of the public authorities law; and (iii) the procurement
17 record requirements pursuant to paragraph g of subdivision nine of
18 section one hundred sixty-three of the state finance law; and
19 (h) provide for any other purposes to effectuate this article.
20 2. State agencies shall administer the rules and regulations promul-
21 gated by the director for the implementation of this article.
22 § 5. The commissioner of the office of general services shall deter-
23 mine the percentage of contracts to be set aside under this legislation
24 for both service-disabled veteran-owned businesses and all veteran-owned
25 businesses.
26 § 6. No later than one-hundred eighty calendar days after this act
27 shall have become law, the commissioner of the office of general
28 services shall complete the study pursuant to section five of this act.
29 § 7. This act shall take effect immediately; provided, however that
30 the amendments to the article heading of article 17-B, sections 369-h,
31 369-i and 369-j of the executive law made by sections one, two, three
32 and four of this act shall not affect the repeal of such article and
33 shall be deemed repealed therewith.
