AN ACT to amend part C of chapter 57 of the laws of 2022 amending the
public health law and the education law relating to allowing pharma-
cists to direct limited service laboratories and order and administer
COVID-19 and influenza tests and modernizing nurse practitioners, in
relation to the effectiveness thereof; and to amend chapter 21 of the
laws of 2011 amending the education law relating to authorizing phar-
macists to perform collaborative drug therapy management with physi-
cians in certain settings, in relation to the effectiveness thereof
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 8 of part C of chapter 57 of the laws of 2022
2 amending the public health law and the education law relating to allow-
3 ing pharmacists to direct limited service laboratories and order and
4 administer COVID-19 and influenza tests and modernizing nurse practi-
5 tioners, is amended to read as follows:
6 § 8. This act shall take effect immediately and shall be deemed to
7 have been in full force and effect on and after April 1, 2022; provided,
8 however, that sections one, two, three, four, six and seven of this act
9 shall expire and be deemed repealed [two years after it shall have
10 become a law] July 1, 2026.
11 § 2. Section 5 of chapter 21 of the laws of 2011 amending the educa-
12 tion law relating to authorizing pharmacists to perform collaborative
13 drug therapy management with physicians in certain settings, as amended
14 by section 5 of part CC of chapter 57 of the laws of 2022, is amended to
15 read as follows:
16 § 5. This act shall take effect on the one hundred twentieth day after
17 it shall have become a law, provided, however, that the provisions of
18 sections two, three, and four of this act shall expire and be deemed

1 repealed July 1, [2024] 2026; provided, however, that the amendments to
2 subdivision 1 of section 6801 of the education law made by section one
3 of this act shall be subject to the expiration and reversion of such
4 subdivision pursuant to section 8 of chapter 563 of the laws of 2008,
5 when upon such date the provisions of section one-a of this act shall
6 take effect; provided, further, that effective immediately, the addi-
7 tion, amendment and/or repeal of any rule or regulation necessary for
8 the implementation of this act on its effective date are authorized and
9 directed to be made and completed on or before such effective date.
10 § 3. This act shall take effect immediately.
