        AN ACT to amend the state finance law, in relation to capping the repay-
          ment of the operation of the  state  lottery  and  allocating  certain
          revenues derived from lottery tickets sold

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Section 92-c of the state finance law is amended by  adding
     2  two new subdivisions 3-a and 3-b to read as follows:
     3    3-a.  For  the  state fiscal year commencing April first, two thousand
     4  eighteen and thereafter, the repayment of  first  instance  expenditures
     5  incurred in the operation of the state lottery pursuant to paragraph (i)
     6  of  subdivision three of this section shall not exceed the amount repaid
     7  in the two thousand seventeen state fiscal year.
     8    3-b. Notwithstanding any inconsistent provision of this section or  of
     9  any  other  provision of law, for the state fiscal year commencing April
    10  first, two thousand eighteen, all revenues derived from lottery  tickets
    11  sold  in  excess  of  the  amount of revenue derived in the two thousand
    12  seventeen state fiscal year shall be used for the purpose of (i) provid-
    13  ing aid to pupils with special educational needs as defined in paragraph
    14  e of subdivision one of section thirty-six hundred two of the  education
    15  law,  and  pupils with handicapping conditions receiving state financial
    16  support for programs delineated in paragraph f  of  subdivision  one  of
    17  section  thirty-six  hundred  two, article eighty-three, article eighty-
    18  five, article eighty-seven, article eighty-eight,  article  eighty-nine,
    19  article  forty  and  subdivision seventeen of section thirty-six hundred
    20  two of the education law, (ii) providing  aid  to  all  school  children
    21  pursuant  to  the  provisions  of  subdivision four of this section, and
    22  (iii) providing aid for elementary and secondary education.
    23    § 2. Nothing contained in this act shall  supersede  or  diminish  the
    24  terms of any applicable collective bargaining agreement.
    25    § 3. This act shall take effect immediately.
