        AN ACT to amend the agriculture and markets law, in relation to a report
          on improving urban and rural  consumer  access  to  locally  produced,
          healthy foods, and to amend a chapter of the laws of 2021 amending the
          agriculture  and  markets  law relating to the task force on improving
          urban and rural consumer access to locally produced, healthy foods, as
          proposed in legislative bills numbers S. 1056 and A. 4613, in relation
          to the effectiveness thereof
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1. Section 28 of the agriculture and markets law, as added by
     2  a chapter of the laws of 2021 amending the agriculture and  markets  law
     3  relating  to the task force on improving urban and rural consumer access
     4  to locally produced, healthy foods, as  proposed  in  legislative  bills
     5  numbers S. 1056 and A. 4613, is amended to read as follows:
     6    §  28.  [Task  force  on] Advisory group for improving urban and rural
     7  consumer access to locally produced, healthy foods. [1. There is  hereby
     8  created  the  task force on improving urban and rural consumer access to
     9  locally produced, healthy foods. The task force is to  be  comprised  of
    10  eleven  members.  Such task force shall have one ex-officio chairperson,
    11  who shall be the] The commissioner [or his or her designee. Four members
    12  shall be appointed by the governor, two members shall  be  appointed  by
    13  the temporary president of the senate, two members shall be appointed by
    14  the speaker of the assembly, one member shall be appointed by the minor-
    15  ity leader of the senate and one member shall be appointed by the minor-
    16  ity  leader  of  the  assembly. The appointed members of such task force
    17  shall be representative of:
    18    (a) a farm engaged in growing crops, livestock or livestock  products,
    19  as defined in section three hundred one of this chapter;
    20    (b)  not-for-profit  food  access organizations dedicated to expanding
    21  access of underserved, urban and rural communities to  healthy,  locally
    22  produced food;
    23    (c) the grocery industry; and

     1    (d)  economic  development agencies serving county, New York state and
     2  New York city government.
     3    Any  vacancy  on  such  task  force  shall  be  filled by the original
     4  appointing authority. Task force members shall receive  no  compensation
     5  for  their  services  but  shall  be reimbursed for actual and necessary
     6  travel expenses incurred in the performance of their duties.
     7    2. The mission of the task force is] shall convene an  advisory  group
     8  with  representatives  from agriculture, food access organizations, food
     9  retailers and economic development agencies to identify  strategies  and
    10  opportunities  to expand access for underserved, nutritionally deficient
    11  urban and rural communities to healthy, locally  produced  food  in  New
    12  York state[. The task force shall develop and identify], including iden-
    13  tifying new and innovative methods to increase the production, marketing
    14  and  distribution of locally produced, fresh food in such communities in
    15  New York state.
    16    [3.] Not later than one year after the effective date of this section,
    17  [the task force] a report shall [report] be delivered by the commission-
    18  er to the governor and the legislature on [its activities,] the findings
    19  and recommendations of such advisory group.
    20    § 2. Section 2 of a chapter of the laws of 2021 amending the  agricul-
    21  ture  and  markets law relating to the task force on improving urban and
    22  rural consumer access to locally produced, healthy foods, as proposed in
    23  legislative bills numbers S. 1056 and A. 4613, is  amended  to  read  as
    24  follows:
    25    §  2.  This  act shall take effect immediately and shall expire and be
    26  deemed repealed [December 31, 2025] after the report  required  pursuant
    27  to section one of this act has been delivered.
    28    §  3.  This  act  shall take effect immediately, provided however that
    29  section one of this act shall take effect on the same date  and  in  the
    30  same  manner  as  a chapter of the laws of 2021 amending the agriculture
    31  and markets law relating to the task force on improving urban and  rural
    32  consumer  access  to  locally  produced,  healthy  foods, as proposed in
    33  legislative bills numbers S. 1056 and A. 4613, takes effect.
