AN ACT to amend the public service law, in relation to fuel cell elec-
tric generating equipment
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Paragraph (g) of subdivision 1 of section 66-j of the
2 public service law, as amended by chapter 530 of the laws of 2011, is
3 amended to read as follows:
4 (g) "Fuel cell electric generating equipment" means:
5 (i)(A) in the case of a residential customer, a solid oxide, molten
6 carbonate, proton exchange membrane or phosphoric acid fuel cell with a
7 combined rated capacity of not more than ten kilowatts; and (B) in the
8 case of a non-residential customer, a solid oxide, molten carbonate,
9 proton exchange membrane or phosphoric acid fuel cell with a combined
10 rated capacity of not more than [one] two thousand [five hundred] kilo-
11 watts; and
12 (ii) that is manufactured, installed and operated in accordance with
13 applicable government and industry standards, that is connected to the
14 electric system and operated in parallel with an electric corporation's
15 transmission and distribution facilities, and that is operated in
16 compliance with any standards and requirements established under this
17 section.
18 § 2. This act shall take effect immediately.
