        Introduced  by  M. of A. WALLACE, SIMON, GALLAGHER, GLICK, TAPIA, GALEF,
          GRIFFIN, McDONALD, MAGNARELLI, STIRPE, CAHILL,  SEAWRIGHT,  O'DONNELL,
          GUNTHER, GOTTFRIED, MORINELLO -- read once and referred to the Commit-
          tee on Health -- committee discharged, bill amended, ordered reprinted
          as amended and recommitted to said committee
 
        AN  ACT  to  amend  the public health law, in relation to establishing a
          statewide advance care planning campaign to promote  public  awareness
          of  hospice  and  palliative  care  services;  and  to  repeal certain
          provisions of such law related thereto
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section 1. Paragraph (e) of subdivision 1 of section 207 of the public
     2  health  law,  as  amended  by section 16 of part A of chapter 109 of the
     3  laws of 2010, is amended to read as follows:
     4    (e) The  commissioner shall establish a statewide advance  care  plan-
     5  ning campaign to:
     6    (i)  promote public awareness of hospice and palliative care services;
     7  and palliative care options for patients  with  a  terminal  illness  or
     8  condition;
     9    (ii)  inform the public of the importance of advance care planning and
    10  the individual's right to direct and participate in  health  care  deci-
    11  sions affecting the individual;
    12    (iii)  educate  individuals  on  the  tools  available to ensure their
    13  health care decisions are honored; and
    14    (iv) the need and importance for consumers and  patients  to  have  an
    15  advance  directive,  particularly  a health care proxy, and the need and
    16  importance for health care  providers  to  play  a  leadership  role  in
    17  discussing  end-of-life care preferences and values with patients and to
    18  provide patients with health care proxy forms.
    19    § 2. Paragraph (h) of subdivision 1  of  section  207  of  the  public
    20  health law is REPEALED.
    21    § 3. This act shall take effect on the one hundred eightieth day after
    22  it  shall have become a law. Effective immediately, the addition, amend-
    23  ment and/or repeal of any rule or regulation necessary for the implemen-
    24  tation of this act on its effective date are authorized to be  made  and
    25  completed on or before such effective date.
