        Introduced  by  M.  of  A.  RICHARDSON  -- read once and referred to the
          Committee on Health
 
        AN ACT  to  amend  the  public  health  law,  in  relation  to  maternal
          depression  treatment;  and  to  amend  a chapter of the laws of 2017,
          amending the public health law, relating to maternal depression treat-
          ment, as proposed in legislative bills numbers S. 4000 and A. 8308, in
          relation to the effectiveness thereof
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Subdivision 3 of section 2500-k of the public health law,
     2  as added by a chapter of the laws of 2017, amending  the  public  health
     3  law  relating  to maternal depression treatment, as proposed in legisla-
     4  tive bills numbers S. 4000 and A. 8308, is amended to read as follows:
     5    3. Maternal depression treatment. The commissioner, in [collaboration]
     6  consultation with the commissioner of mental health, shall:
     7    (a) [compile a list of providers who  treat  or  provide  support  for
     8  maternal   depression   including  mental  health  professionals,  other
     9  licensed professionals, peer support,  not-for-profit  corporations  and
    10  other  community  resources.  Such  list  shall be made available to the
    11  public on the department's website  and  be  searchable  by  zip  code;]
    12  inform   providers  of  the  need  to  raise  awareness  about  maternal
    13  depression; and
    14    (b) [update the list of providers as necessary; and
    15    (c) within existing  appropriations,  ensure  adequate  investment  in
    16  treatment  resources  for  maternal  depression  including  a  statewide
    17  hotline, peer support, adequate  referral  networks  and  telehealth  or
    18  telemedicine  services]  provide  information  on  the  department's and
    19  office of mental health's websites regarding  how  to  locate  available
    20  providers  who  treat or provide support for maternal depression includ-
    21  ing, but not limited to, mental  health  professionals,  other  licensed
    22  professionals,  peer  support,  not-for-profit  corporations  and  other
    23  community resources.
    24    § 2. Section 2 of a chapter of the laws of 2017, amending  the  public
    25  health  law,  relating  to maternal depression treatment, as proposed in
 
         EXPLANATION--Matter in italics (underscored) is new; matter in brackets
                              [ ] is old law to be omitted.

     1  legislative bills numbers S. 4000 and A. 8308, is  amended  to  read  as
     2  follows:
     3    § 2. This act shall take effect [on the first of January next succeed-
     4  ing  the  date  on  which  it  shall  have  become a law] June 30, 2018;
     5  provided, however, that effective immediately, the  addition,  amendment
     6  and/or repeal of any rule or regulation necessary for the implementation
     7  of  this  act  on  its effective date [is] are authorized to be made and
     8  completed by the commissioner of health  on  or  before  such  effective
     9  date.
    10    §  3.  This act shall take effect immediately; provided, however, that
    11  section one of this act shall take effect on the same date  and  in  the
    12  same manner as a chapter of the laws of 2017, amending the public health
    13  law,  relating to maternal depression treatment, as proposed in legisla-
    14  tive bills numbers S. 4000 and A. 8308, takes effect.
