AN ACT to amend the election law, in relation to disclosure of the iden-
tities of political committees making certain expenditures for poli-
tical communications
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivision 2 of section 14-107 of the election law, as
2 amended by a chapter of the laws of 2019, amending the election law
3 relating to disclosure of the identities of political committees making
4 certain expenditures for political communications, as proposed in legis-
5 lative bills numbers S. 4910 and A. 4668, is amended to read as follows:
6 2. Whenever any person makes an independent expenditure, such communi-
7 cation shall, in a manner consistent with section 14-106 of this arti-
8 cle, clearly state the name of the person who paid for, or otherwise
9 published or distributed the communication and state, with respect to
10 communications regarding candidates, that the communication was not
11 expressly authorized or requested by any candidate, or by any candi-
12 date's political committee or any of its agents; provided, however, that
13 paragraphs three and four of section 14-106 of this article shall not
14 apply to the disclosure requirements under this section.
15 § 2. Subdivision 3 of section 14-126 of the election law, as amended
16 by a chapter of the laws of 2019, amending the election law relating to
17 disclosure of the identities of political committees making certain
18 expenditures for political communications, as proposed in legislative
19 bills numbers S. 4910 and A. 4668, is amended to read as follows:
20 3. Any person who falsely identifies or knowingly fails to identify
21 any independent expenditure as required by subdivision two of section
22 14-107 of this article or any political [committee] communication as
23 required in section 14-106 of this article shall be subject to a civil
24 penalty up to one thousand dollars or up to the cost of the communi-
25 cation, whichever is greater, in a special proceeding or civil action
26 brought by the state board of elections chief enforcement counsel pursu-
27 ant to paragraph (a) of subdivision five of section 3-104 of this chap-

1 ter. For purposes of this subdivision, the term "person" shall mean a
2 person, group of persons, corporation, unincorporated business entity,
3 labor organization or business, trade or professional association or
4 organization or political committee.
5 § 3. This act shall take effect on the same date and in the same
6 manner as a chapter of the laws of 2019, amending the election law
7 relating to the disclosure of the identities of political committees
8 making certain expenditures for political communications, as proposed in
9 legislative bills numbers S. 4910 and A. 4668, takes effect.
