KAMINSKY -- read once and referred to the Commit- tee on Governmental Operations AN ACT to amend the executive law, in relation to quarterly claim reports for certain disaster assistance The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 29-k of the executive law, as added by a chapter of 2 the laws of 2015, amending the executive law, relating to quarterly 3 claim reports for certain disaster assistance, as proposed in legisla- 4 tive bills numbers S.4694-A and A.7204-A, is amended to read as follows: 5 § 29-k. Quarterly claim reports. [1.] The [office of the governor, in6cooperation with the commissioner of homeland security and emergency7services, and the executive director of the] governor's office of storm 8 recovery, shall produce a quarterly report, which shall [detail the9claims, and status of all such claims, for disaster assistance, and10which are presently pending before, or being assisted by, the governor's11office of storm recovery and/or the New York rising community recon-12struction plans program. The report shall further detail all the activ-13ities during the previous months of the governor's office of storm14recovery and the New York rising community reconstruction plans program] 15 provide the number of all active single family housing applicants by 16 county that have received partial or full payments; the number of all 17 eligible, active single family housing applicants by county who have not 18 yet received any payments; the number of active single family housing 19 applicants by county who have not received payment and are pending an 20 eligibility review; the number of all active single family housing 21 applicants by county whose application status has not been closed out; 22 the number of all single family housing applicants by county that have 23 been closed out; the number of all single family housing applicants by 24 county that have not received payment because they have been determined 25 to have no unmet need or have been determined ineligible to receive 26 assistance; the number of all active small business applicants by county 27 that have received partial or full payments; the number of all eligible, 28 active small business applicants by county who have not yet received any EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD10285-07-6A. 9173 2 1 payments; the number of active small business applicants by county who 2 have not received payment and are pending an eligibility review; the 3 number of all active small business applicants by county whose applica- 4 tion status has not been closed out; the number of all small business 5 applicants by county that have been closed out; the number of all small 6 business applicants by county that have not received payment because 7 they have been determined to have no unmet need or have been determined 8 ineligible to receive assistance; the total number of subrecipient 9 agreements by county for the New York rising community reconstruction 10 program, and the status of all community reconstruction projects by 11 county that are in the design or construction phases. The report shall 12 provide the same information cumulatively for the previous reporting 13 periods. The first report required under this subdivision shall be 14 delivered by [December first, two thousand fifteen] February fifteenth, 15 two thousand sixteen, with new, updated reports being delivered on each 16 first day of every third month thereafter. The report shall be provided 17 to the temporary president of the senate, and the speaker of the assem- 18 bly and shall be posted on the governor's office of storm recovery's 19 public website. 20 [2. After the delivery of each report required by subdivision one of21this section, and after its delivery to the persons identified to22receive such report, the governor, the commissioner of homeland security23and emergency services, and the executive director of the governor's24office of storm recovery, as well as the offices and divisions under25their direction, shall provide to such persons entitled to receive the26reports required by subdivision one of this section, any and all addi-27tional reasonably available information such persons may request, with28respect to any issue concerning the claims, the status of all claims29detailed in such report pending before, or being assisted by, the gover-30nor's office of storm recovery and the New York rising community recon-31struction plans program, or concerning the activities of the governor's32office of storm recovery and/or the New York rising community recon-33struction plans program.] 34 § 2. This act shall take effect on the same date and in the same 35 manner as a chapter of the laws of 2015, amending the executive law, 36 relating to quarterly claim reports for certain disaster assistance, as 37 proposed in legislative bills numbers S.4694-A and A.7204-A.
