          on Racing and Wagering
 
        AN  ACT to amend the state finance law, in relation to directing revenue
          from certain mobile casino gaming activities to  be  used  for  school
          safety and security purposes
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Subdivision 3 of section 92-c of the state finance law,  as
     2  amended  by  chapter  913  of  the  laws  of 1977, is amended to read as
     3  follows:
     4    3. The moneys in such fund shall be appropriated or  transferred  only
     5  (i)  for repayment of first instance expenditures incurred in the opera-
     6  tion of the state lottery, (ii) for the  state  fiscal  year  commencing
     7  April  first,  nineteen  hundred  seventy-six  only  for  the purpose of
     8  providing aid to pupils with special educational  needs  as  defined  in
     9  paragraph  e of subdivision one of section thirty-six hundred two of the
    10  education law, and pupils with handicapping conditions  receiving  state
    11  financial  support for programs delineated in paragraph f of subdivision
    12  one of section thirty-six hundred  two,  article  eighty-three,  article
    13  eighty-five,  article eighty-seven, article eighty-eight, article eight-
    14  y-nine, article forty and subdivision seventeen  of  section  thirty-six
    15  hundred two of the education law, and for any state fiscal year commenc-
    16  ing  after such nineteen hundred seventy-six fiscal year for the purpose
    17  of providing aid to all school children pursuant to  the  provisions  of
    18  subdivision  four  of  this  section, (iii) for elementary and secondary
    19  education, provided, however, upon the authorization and legalization of
    20  interactive gaming, including any internet-based version or  substantial
    21  equivalent  of  a  table game, slot machine constituting spinning reels,
    22  poker tournament, or any other game as set forth  in  subdivision  four,
    23  nineteen,  thirty-eight,  thirty-nine  or  forty-one of section thirteen
    24  hundred one of the racing, pari-mutuel wagering and  breeding  law,  and
    25  approved by the gaming commission and which is accessed by a computer or
    26  mobile  device  which is connected to the internet, at least ten million
    27  dollars or one percent, whichever is greater, of such revenues shall  be

     1  used  for any expenses related to school safety and security purposes as
     2  determined by the commissioner of education, (iv) for  expenditures  for
     3  machines or other capital equipment which the division of the lottery is
     4  authorized  to  purchase  for  the  operation of the lottery and (v) for
     5  payment in the state  fiscal  years  commencing  April  first,  nineteen
     6  hundred  seventy-seven,  nineteen  hundred  seventy-eight  and  nineteen
     7  hundred seventy-nine into the winter sports  education  trust  fund,  as
     8  created  in  section  four hundred ninety-five-a of article ten-C of the
     9  education law, for the purposes of such  fund  in  accordance  with  the
    10  provisions of subdivision five of this section. Payments into such trust
    11  fund  shall  discontinue  at such time as the sum of one hundred million
    12  dollars, in the aggregate, has been paid into such fund  or  upon  March
    13  thirty-first,  nineteen  hundred  eighty,  whichever event occurs first.
    14  Nothing herein shall prohibit the purchase of machines or other  capital
    15  equipment  from  funds appropriated for expenditures under paragraph (i)
    16  hereof.
    17    § 2. This act shall take effect immediately.
