          McDONALD,  ZEBROWSKI, SIMON, JACOBSON -- read once and referred to the
          Committee on Education -- committee discharged, bill amended,  ordered
          reprinted as amended and recommitted to said committee

        AN  ACT  to  amend  the  education law, in relation to first aid certif-
          ication for coaches and staff of high school athletics
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Section  3001-b of the education law, as added by chapter
     2  498 of the laws of 1991, is amended to read as follows:
     3    § 3001-b. First aid instruction mandatory for coaches  of  extra-class
     4  public school athletic activities. 1. On and after the effective date of
     5  this  section, in addition to any provision of law or rule or regulation
     6  of the department related to the  requirements  necessary  for  teachers
     7  within  the  public school systems, whether certified in physical educa-
     8  tion or not, to coach any extra-class athletic  activity,  it  shall  be
     9  required  of  such  teachers,  except  as provided in subdivision two or
    10  three of this section, to hold a valid certificate of  completion  of  a
    11  course  of study in first aid knowledge and skills offered by the Ameri-
    12  can National Red Cross and approved by  the  commissioner,  or  to  meet
    13  equivalent  requirements  as  certified  by  the  commissioner. Any such
    14  course of study or equivalent requirements must include  instruction  in
    15  the  administration of adult cardiopulmonary resuscitation. Prior to the
    16  start of each sports season, coaches  must  provide  valid  evidence  to
    17  their  chief  school officer that their first aid and adult cardiopulmo-
    18  nary resuscitation knowledge and skills  are  current  pursuant  to  the
    19  requirements established by the American National Red Cross or that they
    20  meet equivalent requirements as certified by the commissioner.
    21    2.  [Persons] Except as provided in subdivision three of this section,
    22  persons who have been employed as coaches of extra-class athletic activ-
    23  ities in a public school system on the effective date  of  this  section
    24  who  do  not hold a valid certificate of completion of a course of study
    25  in first aid knowledge and skills pursuant to subdivision  one  of  this

     1  section  may continue to coach such sports, provided, however, that such
     2  coaches do receive such certification required  in  subdivision  one  of
     3  this  section  as  soon  as practicable after the effective date of this
     4  section  but not later than twelve months thereafter, provided, however,
     5  that the commissioner shall have the authority to establish by  rule  or
     6  regulation an additional time schedule for compliance with this section.
     7    3.  A  teacher  or person who is unable to hold a valid certificate of
     8  completion of a course of study in first aid knowledge and skills pursu-
     9  ant to subdivision one of this section due to a physical disability  may
    10  coach  any  extra-class athletic activity if there is another teacher or
    11  person employed by the public school system who holds  a  valid  certif-
    12  icate  of  completion pursuant to subdivision one of this section and is
    13  present with such teacher or person who is unable to hold  such  certif-
    14  icate  of completion at all times during the extra-class athletic activ-
    15  ities including but not limited  to  practices,  scrimmages  and  during
    16  competition.
    17    §  2. Subdivision 1 of section 3001-b of the education law, as amended
    18  by chapter 500 of the laws of 2021, is amended to read as follows:
    19    1. On and after the effective date of this section, in addition to any
    20  provision of law or rule or regulation of the department related to  the
    21  requirements  necessary  for  teachers within the public school systems,
    22  whether certified in physical education or not, to coach any extra-class
    23  athletic activity, it shall be required  of  such  teachers,  except  as
    24  provided  in  subdivision  two or three of this section, to hold a valid
    25  certificate of completion of a course of study in  first  aid  knowledge
    26  and  skills  offered by a nationally recognized organization, as defined
    27  in paragraph (d) of subdivision one of section three thousand-b  of  the
    28  public  health  law  and approved by the commissioner, or to meet equiv-
    29  alent requirements as certified by the commissioner. Any such course  of
    30  study or equivalent requirements must include instruction in recognizing
    31  signs  and  symptoms of cardiac arrest and sudden cardiac arrest and the
    32  administration of adult  cardiopulmonary  resuscitation.  Prior  to  the
    33  start  of  each  sports  season,  coaches must provide valid evidence to
    34  their chief school officer that their first aid and  adult  cardiopulmo-
    35  nary  resuscitation  knowledge  and  skills  are current pursuant to the
    36  requirements established by a  nationally  recognized  organization,  as
    37  defined  in paragraph (d) of subdivision one of section three thousand-b
    38  of the public health law and approved by the commissioner, or that  they
    39  meet equivalent requirements as certified by the commissioner.
    40    §  3.  Section  3001-c of the education law, as added by chapter 39 of
    41  the laws of 1994, is amended to read as follows:
    42    § 3001-c. First aid instruction mandatory for coaches of  high  school
    43  extra-class  nonpublic  school  athletic activities. 1. On and after the
    44  effective date of this section, it shall be required of coaches of  high
    45  school  extra-class  athletic  activities  in a nonpublic school system,
    46  except as provided in subdivision two or three of this section, to  hold
    47  a  valid  certificate  of  completion  of a course of study in first aid
    48  knowledge and skills offered by the  American  National  Red  Cross  and
    49  approved  by  the  commissioner,  or  to meet equivalent requirements as
    50  certified by the commissioner. Any such course of  study  or  equivalent
    51  requirements  must  include  instruction  in the administration of adult
    52  cardiopulmonary resuscitation. Prior to the start of each sports season,
    53  coaches must provide valid evidence to their chief school  officer  that

    22  such  certificate  of  completion  at  all  times during the high school
    23  extra-class athletic activities including but not limited to  practices,
    24  scrimmages and during competition.
    25    §  4. Subdivision 1 of section 3001-c of the education law, as amended
    26  by chapter 500 of the laws of 2021, is amended to read as follows:
    27    1. On and after the effective  date  of  this  section,  it  shall  be
    28  required  of coaches of high school extra-class athletic activities in a
    29  nonpublic school system, except as provided in subdivision two or  three
    30  of  this  section, to hold a valid certificate of completion of a course
    31  of study in first aid knowledge  and  skills  offered  by  a  nationally
    32  recognized  organization, as defined in paragraph (d) of subdivision one
    33  of section three thousand-b of the public health law and approved by the
    34  commissioner, or to meet equivalent requirements  as  certified  by  the
    35  commissioner.  Any  such course of study or equivalent requirements must
    36  include instruction in recognizing signs and symptoms of cardiac  arrest
    37  and  sudden  cardiac arrest and the administration of adult cardiopulmo-
    38  nary resuscitation. Prior to the start of each  sports  season,  coaches
    39  must  provide  valid  evidence  to their chief school officer that their
    40  first aid and adult cardiopulmonary resuscitation knowledge  and  skills
    41  are  current  pursuant  to  the requirements established by a nationally
    42  recognized organization, as defined in paragraph (d) of subdivision  one
    43  of section three thousand-b of the public health law and approved by the
    44  commissioner,  or that they meet equivalent requirements as certified by
    45  the commissioner.
    46    § 5. This act shall take effect immediately provided, however that:
    47    (a) the amendments to subdivision 1 of section 3001-b of the education
    48  law made by section two of this act shall take effect on the  same  date
    49  and in the same manner as chapter 500 of the laws of 2021, takes effect;
    50  and
    51    (b) the amendments to subdivision 1 of section 3001-c of the education
    52  law  made by section four of this act shall take effect on the same date
    53  and in the same manner as chapter 500 of the laws of 2021, takes effect.
