AN ACT to amend the education law, in relation to international bacca-
laureate examinations
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Paragraph b of subdivision 5 of section 809 of the educa-
2 tion law, as amended by chapter 542 of the laws of 1994, is amended to
3 read as follows:
4 b. Notwithstanding any inconsistent provision of this section, the
5 commissioner may, upon the submission of a written program plan, issue
6 to such school a written waiver of such restrictions for students
7 subject to the following provisions: (i) the student shall be in grade
8 ten, eleven, or twelve; and (ii) the student shall be under the super-
9 vision of one or more teachers certified in science; and (iii) the
10 student shall be pursuing an accelerated course of study in the sciences
11 as defined by the commissioner in preparation for taking a state or
12 national advanced placement examination or international baccalaureate.
13 The commissioner shall issue a waiver of such restrictions for any
14 teacher certified in science instructing such student. The written
15 program plan shall include, but not be limited to: (i) the educational
16 basis for requesting a waiver; (ii) the objective of the lesson or
17 experiment; (iii) the methods and techniques to be used; and (iv) any
18 other information required by the commissioner.
19 § 2. Paragraph b of subdivision 2 of section 669-g of the education
20 law, as added by section 1 of part Z of chapter 56 of the laws of 2015,
21 is amended to read as follows:
22 b. graduated with a "with honors" distinction on a New York state
23 regents diploma [or], received a score of 3 or higher on two or more
24 advanced placement examinations, received a score of 3 or higher on one
25 or more international baccalaureate higher level examinations, or
26 received a score of 4 or higher on one or more international baccalau-
27 reate standard level examinations; or

1 § 3. This act shall take effect on the first of January next succeed-
2 ing the date on which it shall have become a law; provided, however,
3 that effective immediately, the addition, amendment and/or repeal of any
4 rule or regulation necessary for the implementation of this act on its
5 effective date is authorized to be made and completed on or before such
6 effective date.
