36 review the new ASTM standard specification as follows:
37 (a) If the department determines that the new standard, when compared
38 to the ASTM standard specification prior to its revision, is more strin-
39 gent and more protective of public health, public safety, and the envi-
40 ronment, and is reflective of and consistent with state policies and
41 programs, the department may adopt the new standard.
42 (b) If the department determines that the new standard, when compared
43 to the ASTM standard specification prior to its revision, is not as
44 stringent and does not protect public health, public safety, and the

50 may review the new standard and, if the department determines that the
51 new standard for the prohibited term, when compared to the current ASTM
52 standard in effect, is more stringent and more protective of public
53 health, public safety, and the environment, and is reflective of and
54 consistent with state policies and programs, the department may make a
    55 recommendation to the legislature.

        A. 9628 3

1 3. The department may adopt an existing standard different from an
2 adopted ASTM standard specification if all the following conditions are
     3 met:
4 (a) The existing standard is adopted or developed by a standard-set-
5 ting organization recognized by the department, including, but not
6 limited to, the ASTM or another similar organization.
7 (b) The existing standard adds qualifications to the adopted ASTM
8 standard specification, including, but not limited to, home compostable.
9 (c) The department determines that the existing standard is more
10 stringent than the adopted ASTM standard specification for which that
    11 existing standard qualifies.
12 4. Compliance with a standard adopted pursuant to this section shall
13 be deemed to be in compliance with this title.
    14 § 27-3005. Labeling of plastics.
15 1. (a) Except as provided in paragraph (c) of this subdivision, a
16 person shall not sell a plastic product that is labeled with the term
17 "compostable," "home compostable," or "marine degradable" unless, at the
18 time of sale, the plastic product meets the applicable ASTM standard
19 specification or the Vincotte OK Compost HOME certification, as provided
20 in paragraph (d) of this subdivision.
21 (b) Compliance with only a section or a portion of a section of an
22 applicable ASTM standard specification does not constitute compliance
23 with paragraph (a) of this subdivision.
24 (c) Notwithstanding paragraph (a) of this subdivision, a person may
25 sell a plastic product that is labeled with a qualified claim for a term
26 specified in paragraph (a) of this subdivision, if the plastic product
27 meets the relevant standard adopted by the department.
28 (d) A plastic product shall not be labeled with the term "home
29 compostable" unless the manufacturer of that plastic product holds a
30 Vincotte OK Compost HOME certificate of conformity with regard to that
    31 product, except:
32 (i) Notwithstanding paragraph (a) of this subdivision, if the ASTM
33 adopts a standard specification for the term "home compostable" and the
34 department determines that the ASTM standard specification is at least
35 equal to, or more stringent than, the OK Compost HOME certification, a
36 plastic product labeled with the term "home compostable" shall meet that
37 ASTM standard specification. The department may also take the actions
38 specified in subdivision three of section 27-3003 of this title with
39 regard to an ASTM standard for home compostability.
40 (ii) If the department adopts a standard pursuant to subdivision three
41 of section 27-3003 of this title, a plastic product labeled with the
42 term "home compostable" shall meet that standard.
43 2. Except as provided in subdivision one, a person shall not sell a
44 plastic product that is labeled with the term "biodegradable," "degrada-
45 ble," or "decomposable," or any form of those terms, or in any way imply
46 that the plastic product will break down, fragment, biodegrade, or
47 decompose in a landfill or other environment.
48 3. A manufacturer or supplier, upon the request of a member of the
49 public, shall submit to that member, within ninety days of the request,
50 information and documentation demonstrating compliance with this title,
51 in a format that is easy to understand and scientifically accurate.
52 4. A product that is in compliance with this title shall not, solely
53 as a result of that compliance, be deemed to be in compliance with any
54 other applicable marketing requirement or guideline established under
55 state law or by the Federal Trade Commission.
    56 § 27-3007. Compostable plastic bags.

1 1. A manufacturer of a compostable plastic bag meeting the adopted
2 ASTM standard specification shall ensure that the compostable plastic
3 bag is readily and easily identifiable from other plastic bags in a
4 manner that is consistent with the Federal Trade Commission Guides for
5 the Use of Environmental Marketing Claims (Part 260 (commencing with
6 Section 260.1) of Subchapter B of Chapter I of Title 16 of the Code of
     7 Federal Regulations).
8 2. A compostable plastic bag sold or distributed shall not display a
9 chasing arrow resin identification code or recycling type of symbol in
    10 any form.
11 3. A manufacturer is required to comply with this section only to the
12 extent that the labeling requirements do not conflict with the Federal
13 Trade Commission Guides for the Use of Environmental Marketing Claims
14 (Part 260 (commencing with Section 260.1) of Subchapter B of Chapter I
15 of Title 16 of the Code of Federal Regulations).
    16 § 27-3009. Environmental marketing information.
17 1. A manufacturer or supplier making an environmental marketing claim
18 relating to the recycled content of a plastic food container product
19 shall maintain information and documentation, which shall be in written
20 form in its records, of both of the following in support of that claim:
21 (a) The recycled content for materials has been recovered or otherwise
22 diverted from the solid waste stream either during the manufacturing
23 process or after consumer use.
24 (b) The recycled content claim conforms to the uniform standards for
25 recycled content contained in the Federal Trade Commission Guides for
26 the Use of Environmental Marketing Claims (16 C.F.R. Part 260).
27 2. A manufacturer or supplier shall furnish the information and
28 documentation that it is required to maintain pursuant to this section
29 to any member of the public upon request or provide the information and
30 documentation by furnishing a link to a document on its website contain-
31 ing the information and documentation.
32 3. This section does not limit the requirements of this title or any
    33 other provision of law.
    34 § 27-3011. Civil liability.
35 1. Any municipality or the state may impose civil liability in the
36 amount of five hundred dollars for the first violation of this title,
37 one thousand dollars for the second violation, and two thousand dollars
38 for the third and any subsequent violation.
39 2. Any civil penalties collected pursuant to subdivision one of this
40 section shall be paid to the town, village, city, district attorney, or
41 attorney general, whichever office brought the action. The penalties
42 collected pursuant to this section by the attorney general may be
43 expended by the attorney general, upon appropriation by the legislature,
    44 to enforce this title.
45 3. The remedies provided by this section shall not be exclusive and
46 are in addition to the remedies that may be available pursuant to Chap-
47 ter 5 (commencing with Section 17200) of Part 2 of Division 7 of the
    48 Business and Professions Code.
49 4. The costs incurred in carrying out this title shall be recoverable
50 by the attorney general, upon the request of the department, from the
