        Introduced  by M. of A. BURDICK -- read once and referred to the Commit-
          tee on Governmental Employees
 
        AN ACT to amend the civil service law, in relation to online testing for
          civil service examinations
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1. Section 50 of the civil service law is amended by adding a
     2  new subdivision 5-b to read as follows:
     3    5-b. Online examinations. Notwithstanding the provisions  of  subdivi-
     4  sion five-a of this section, and in the event that the department deter-
     5  mines to exercise such discretionary authority, the department may offer
     6  online  testing  for  examinations  as  it deems appropriate in its sole
     7  discretion. Nothing in this subdivision shall require the department  to
     8  offer  online  testing  for  any  particular examination, any particular
     9  position or any particular applicant, regardless of whether it has  done
    10  so  previously.  The president shall promulgate rules and regulations to
    11  implement the provisions of this subdivision, including rules and  regu-
    12  lations  for  the  identification of appropriate examinations, positions
    13  and applicants for online testing.
    14    § 2. This act shall take effect on the one hundred eightieth day after
    15  it shall have become a law. Effective immediately, the addition,  amend-
    16  ment and/or repeal of any rule or regulation necessary for the implemen-
    17  tation  of  this act on its effective date are authorized to be made and
    18  completed on or before such effective date.
