AN ACT to amend the education law, in relation to solar arrays on
certain eligible school buildings
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The education law is amended by adding a new section 409-n
2 to read as follows:
3 § 409-n. Solar arrays on school buildings. 1. Notwithstanding any
4 other provision of law, rule or regulation, every school district with
5 less than one million residents shall develop a plan to deploy solar
6 arrays on the roofs of twenty percent of eligible school buildings.
7 2. If the provisions of the local finance law relating to bonding is
8 completed, such solar arrays shall be installed by January first, two
9 thousand twenty-seven. By January first, two thousand thirty, fifty
10 percent of eligible school buildings shall use solar power and by two
11 thousand thirty-five, one hundred percent of eligible school buildings
12 shall use solar power.
13 3. Any expenditures necessary for compliance with this section shall
14 be exempt from section three-c of the general municipal law.
15 4. For the purposes of this section, an eligible school building shall
16 be a building which, with no major modification, could successfully
17 house solar arrays.
18 § 2. This act shall take effect on the one hundred eightieth day after
19 it shall have become a law.
