AN ACT to amend the vehicle and traffic law, in relation to the use of
photographs taken by school zone speed cameras and bus lane cameras in
certain administrative and adjudicatory proceedings
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subparagraph (ii) of paragraph 3 of subdivision (a) of
2 section 1111-c of the vehicle and traffic law, as added by section 9 of
3 part II of chapter 59 of the laws of 2010, is amended to read as
4 follows:
5 (ii) a prohibition on the use or dissemination of vehicles' license
6 plate information and other information and images captured by bus lane
7 photo devices except: (A) as required to establish liability under this
8 section or collect payment of penalties; (B) as required by court order;
9 [or] (C) as requested by other agencies of the city of New York for use
10 in administrative or adjudicatory proceedings against the vehicle's
11 owner or operator, where the identity of the operator of the vehicle may
12 be ascertained through means other than the images produced by a bus
13 lane photo device; or (D) as otherwise required by law;
14 § 2. Subclause 3 of clause (B) of subparagraph (ii) of paragraph 5 of
15 subdivision (a) of section 1180-b of the vehicle and traffic law is
16 renumbered subclause 4 and a new subclause 3 is added to read as
17 follows:
18 (3) shall be furnished in response to a request from an agency of the
19 city of New York for use in an administrative or adjudicatory body in
20 any action or proceeding therein against a vehicle's owner or operator,
21 where the identity of the operator may be ascertained through means
22 other than the images produced by a photo speed violation monitoring
23 system; and
24 § 3. This act shall take effect immediately, provided, however, that
25 the amendments to sections 1111-c and 1180-b of the vehicle and traffic
26 law made by sections one and two of this act shall not affect the repeal
27 of such sections and shall expire and be deemed repealed therewith.
