        Introduced by M. of A. JAFFEE -- read once and referred to the Committee
          on Health
 
        AN  ACT to amend the public health law, in relation to the membership of
          the early intervention coordinating council
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1. Paragraphs (b) and (c) of subdivision 1 of section 2553 of
     2  the public health law, paragraph (b) as amended by chapter  135  of  the
     3  laws  of 2012 and paragraph (c) as amended by chapter 231 of the laws of
     4  1993, are amended to read as follows:
     5    (b) The council shall consist of [twenty-seven] thirty members, unless
     6  otherwise required by federal law, appointed by the governor.  At  least
     7  five members shall be parents, four of whom shall be parents of children
     8  with  disabilities  aged  twelve or younger and one of whom shall be the
     9  parent of a child with disabilities aged six or younger; at  least  five
    10  shall  be representatives of public or private providers of early inter-
    11  vention services; at least one shall be involved in  personnel  prepara-
    12  tion  or  training;  at  least three shall be representatives of managed
    13  care plans or managed care plan trade  associations  familiar  with  how
    14  claims  for  services  provided  pursuant  to this title are managed; at
    15  least two shall be early intervention officials; at least two  shall  be
    16  members  of  the  legislature;  seven  shall be the commissioner and the
    17  commissioners of education, the office of children and family  services,
    18  people  with  developmental  disabilities, mental health, alcoholism and
    19  substance abuse services and the superintendent of  financial  services,
    20  or  their  appropriate  designees with sufficient authority to engage in
    21  policy planning and implementation on behalf of their agencies.
    22    (c) The governor shall appoint [eight] ten members on the  recommenda-
    23  tion  of  the  temporary  president of the senate and the speaker of the
    24  assembly, each of whom shall recommend [four] five members  as  follows:
    25  one  parent  of  a  child  with  disabilities age twelve or younger; one
    26  representative of public or  private  providers  of  early  intervention
    27  services; one representative of a managed care plan or managed care plan
    28  trade  association familiar with how claims for services provided pursu-

     1  ant to this title are managed; one member of the  legislature;  and  one
     2  early  intervention official. The governor shall appoint four members on
     3  the recommendations of the minority  leader  of  the  assembly  and  the
     4  minority  leader of the senate, each of whom shall recommend two members
     5  as follows: one parent of a child with disabilities age twelve or young-
     6  er; one representative of public or private providers  of  early  inter-
     7  vention services.
     8    § 2. This act shall take effect on the one hundred eightieth day after
     9  it shall have become a law.
