NOLAN, BENEDETTO, CRESPO, GIBSON, JAFFEE, LANC- MAN, MAISEL, MARKEY, M. MILLER, P. RIVERA, SCARBOROUGH, TITONE, TITUS -- Multi-Sponsored by -- M. of A. ABBATE, GLICK, REILLY, SIMANOWITZ -- read once and referred to the Committee on Education AN ACT to amend the education law, in relation to transportable class- room units The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 2556 of the education law is amended by adding a 2 new subdivision 15 to read as follows: 3 15. a. The chancellor of a city school district in a city having a 4 population of one million or more shall compile an inventory of and 5 issue a written report about transportable classroom units ("TCU" or 6 also commonly known as a "trailer"). Such inventory and report shall: 7 (i) identify each transportable classroom unit located in the city 8 school district. Each transportable classroom unit shall be identified 9 by the community school district in which it is located, its address 10 with identification of any school building it is part of or associated 11 with, its approximate size, its age, and a description of its physical 12 condition; 13 (ii) identify the number of students served within each transportable 14 classroom unit, including the grade level of such students, if applica- 15 ble, the average class size within each transportable classroom unit, 16 and a description of the amount of the school day the students spend 17 within each transportable classroom unit; 18 (iii) describe any capital plan provisions pertaining to each trans- 19 portable classroom unit, if no capital plan provision exists for a 20 particular transportable classroom unit then indicate to that effect; 21 and 22 (iv) include a plan, that shall be incorporated within any proposed 23 amendment to the current capital plan, for reducing the number of trans- 24 portable classroom units within the city school district during the time 25 frame of the current capital plan. On or before December thirty-first, two thousand thirteen, the 2 chancellor shall submit the inventory and report, compiled pursuant to 3 paragraph a of this subdivision, to the governor, the temporary presi- 4 dent of the senate, the speaker of the assembly, the chairs of the 5 senate and assembly committees on education, and the department. 6 § 2. Section 2590-h of the education law is amended by adding a new 7 subdivision 53 to read as follows: 8 53. To compile an inventory of and issue a written report about the 9 transportable classroom units in the city school district, as required 10 by subdivision fifteen of section twenty-five hundred fifty-six of this 11 title. 12 § 3. This act shall take effect immediately; provided, however, that 13 the amendment made to section 2590-h of the education law by section two 14 of this act shall not affect the expiration of such section and shall be 15 deemed to expire therewith.
