AN ACT to amend the social services law, in relation to setting public
assistance amounts for individuals receiving enhanced residential care
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Paragraph (c) of subdivision 1 of section 131-o of the
2 social services law, as amended by section 1 of part L of chapter 56 of
3 the laws of 2019, is amended to read as follows:
4 (c) in the case of each individual receiving enhanced residential
5 care, an amount equal to at least [$204.00]:
6 (i) $207.00 for each month beginning on or after January first, two
7 thousand nineteen;
8 (ii) $226.00 for each month beginning on or after April first, two
9 thousand twenty;
10 (iii) $243.00 for each month beginning on or after January first, two
11 thousand twenty-one;
12 (iv) $262.00 for each month beginning on or after January first, two
13 thousand twenty-two;
14 (v) $281.00 for each month beginning on or after January first, two
15 thousand twenty-three;
16 (vi) $300.00 for each month beginning on or after January first, two
17 thousand twenty-four.
18 § 2. Paragraph (e) of subdivision 2 of section 209 of the social
19 services law, as amended by section 2 of part L of chapter 56 of the
20 laws of 2019, is amended to read as follows:
21 (e) [On and after] (i) (1) From January first, two thousand [nineteen]
22 twenty to March thirty-first, two thousand twenty, [(i)] for an eligible
23 individual receiving enhanced residential care, $1,465.00; and [(ii)]
24 (2) for an eligible couple receiving enhanced residential care, two
25 times the amount set forth in [subparagraph (i)] clause one of this
26 [paragraph] subparagraph.
27 (ii) (1) From April first, two thousand twenty to December thirty-
28 first, two thousand twenty, for an eligible individual receiving

1 enhanced residential care, $1,496.00; and (2) for an eligible couple
2 receiving enhanced residential care, two times the amount set forth in
3 clause one of this subparagraph.
4 (iii) (1) From January first, two thousand twenty-one to December
5 thirty-first, two thousand twenty-one, for an eligible individual
6 receiving enhanced residential care, $1,513.00; and (2) for an eligible
7 couple receiving enhanced residential care, two times the amount set
8 forth in clause one of this subparagraph.
9 (iv) (1) From January first, two thousand twenty-two to December thir-
10 ty-first, two thousand twenty-two, for an eligible individual receiving
11 enhanced residential care, $1,532.00; and (2) for an eligible couple
12 receiving enhanced residential care, two times the amount set forth in
13 clause one of this subparagraph.
14 (v) (1) From January first, two thousand twenty-three to December
15 thirty-first, two thousand twenty-three, for an eligible individual
16 receiving enhanced residential care, $1,551.00; and (2) for an eligible
17 couple receiving enhanced residential care, two times the amount set
18 forth in clause one of this subparagraph.
19 (vi) (1) From January first, two thousand twenty-four to December
20 thirty-first, two thousand twenty-four, for an eligible individual
21 receiving enhanced residential care, $1,570.00; and (2) for an eligible
22 couple receiving enhanced residential care, two times the amount set
23 forth in clause one of this subparagraph.
24 § 3. Section 131-a of the social services law is amended by adding a
25 new subdivision 6 to read as follows:
26 6. Notwithstanding any other provision of law, social services offi-
27 cials shall, in accordance with the provisions of this section, provide
28 public assistance to persons and families who receive temporary housing
29 assistance and three meals per day or reside in a shelter for adults
30 that provides three meals per day, a shelter for families that provides
31 three meals per day, or a public home that provides three meals per day
32 and determined to be eligible by the application of the standard of need
33 prescribed by the provisions of subdivision two of this section, less
34 any available income or resources which are not required to be disre-
35 garded by other provisions of this chapter, in accordance with the
36 following monthly schedule:

40 For each additional eligible needy person in the household there shall
41 be an additional allowance of ninety-six dollars monthly.
42 § 4. This act shall take effect on the same date and in the same
43 manner as sections 1 and 2 of part L of chapter 56 of the laws of 2019
44 take effect; provided, however, that section three of this act shall
45 take effect on the first of April in the year next succeeding the year
46 in which it shall have become a law.
