AN ACT to amend the general business law, in relation to requiring auto-
mated teller machine operators to install global positioning systems
within each machine
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The general business law is amended by adding a new section
2 399-y-2 to read as follows:
3 § 399-y-2. Automated teller machine; global positioning system instal-
4 lation. 1. For the purposes of this section, "automated teller machine
5 operator" shall mean any person who operates an automated teller machine
6 at which consumers may make financial transactions, including but not
7 limited to deposits, withdrawals, balance inquiries, and loan payments;
8 and is not the financial institution which holds the account accessed by
9 the consumer to make the financial transaction.
10 2. An automated teller machine operator shall ensure that any auto-
11 mated teller machine located on such operator's premises is equipped
12 with a global positioning system.
13 3. The automated teller machine operator shall also ensure that such
14 automated teller machine displays a sticker indicating that such machine
15 is equipped with a global positioning system device.
16 § 2. This act shall take effect immediately.
