AN ACT to amend the public authorities law, in relation to providing
discounted congestion charge rates for certain transportation network
company vehicles
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The public authorities law is amended by adding a new
2 section 2858 to read as follows:
3 § 2858. Discounted rates for certain transportation network company
4 vehicles. 1. Notwithstanding the provisions of any law to the contrary,
5 if any authority shall implement any tolls, fares, fees or other charges
6 for the purpose of raising revenues for public transit systems, such
7 tolls, fares, fees or other charges shall be reduced by the following
8 amounts for the following types of vehicles for transportation network
9 companies:
10 a. for an electric or hydrogen fuel cell vehicle the rate of such
11 tolls, fares, fees or other charges shall be one-half of the rate estab-
12 lished to raise revenue; and
13 b. for a hybrid electric vehicle the rate of such tolls, fares, fees
14 or other charges shall be three-fourths of the rate established to raise
15 revenue.
16 2. For the purposes of this section the following terms shall have the
17 following meanings:
18 a. The term "electric or hydrogen fuel cell vehicle" shall mean and
19 include a motor vehicle that:
20 (i) has four wheels;
21 (ii) was manufactured for use primarily on public streets, roads and
22 highways;
23 (iii) the powertrain of which has not been modified from the original
24 manufacturer's specifications;
25 (iv) is rated at not more than eight thousand five hundred pounds
26 gross vehicle weight;

1 (v) has a maximum speed capability of at least fifty-five miles per
2 hour; and
3 (vi) is propelled at least in part by an electric motor and associated
4 power electronics which provide acceleration torque to the drive wheels
5 sometime during normal vehicle operations, and that draws electricity
6 from a hydrogen fuel cell or from a battery that:
7 (A) has a capacity of not less than four kilowatt hours; and
8 (B) is capable of being recharged from an external source of electric-
9 ity.
10 b. The term "hybrid electric vehicle" shall mean and include a commer-
11 cially available mass production motor vehicle originally equipped by
12 the manufacturer with a combustion engine system and electric propulsion
13 system that operate in an integrated manner.
14 c. The term "transportation network company" shall have the same mean-
15 ing as subdivision one of section sixteen hundred ninety-one of the
16 vehicle and traffic law.
17 § 2. This act shall take effect immediately.
