Nolan, Buchwald, Jaffee, Mayer, Otis, Pretlow, Paulin) -- read once and referred to the Committee on Education AN ACT to amend the education law, in relation to kindergarten programs The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 1 of section 1712 of the education law, is 2 amended to read as follows: 3 1. The board of education of each school district may maintain kinder- 4 gartens which shall be free to resident children between the ages of 5 four and six years, provided, however, such board may fix a higher mini- 6 mum age for admission to such kindergartens. Provided that school 7 districts that receive state funds to operate a pre-kindergarten program 8 during the school year shall be required to maintain kindergarten 9 programs during the school year. 10 § 2. Subdivision 1 of section 2514 of the education law, as added by 11 chapter 762 of the laws of 1950, is amended to read as follows: 12 1. The board of education of each city school district may maintain 13 kindergartens which shall be free to resident children between the ages 14 of four and six years, provided, however, such board may fix a higher 15 minimum age for admission to such kindergartens. Provided that school 16 districts that receive state funds to operate a pre-kindergarten program 17 during the school year shall be required to maintain kindergarten 18 programs during the school year. 19 § 3. Subdivision 1 of section 2555 of the education law, such section 20 as renumbered by chapter 762 of the laws of 1950, is amended to read as 21 follows: 22 1. The board of education of each city may maintain kindergartens 23 which shall be free to resident children between the ages of four and 24 six years, provided, however, such board may fix a higher minimum age 25 for admission to such kindergartens. Provided that school districts 26 that receive state funds to operate a pre-kindergarten program during 27 the school year shall be required to maintain kindergarten programs 28 during the school year.
