        Introduced  by  M.  of  A.  DelMONTE,  PARMENT,  GIGLIO -- read once and

        AN ACT to  amend  the  public  health  law,  in  relation  to  inpatient
          reimbursement rates for general hospitals
 

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Paragraph (g) of subdivision 35 of section  2807-c  of  the
     2  public  health  law is amended by adding a new subparagraph (vi) to read
     3  as follows:
     4    (vi) (A) Notwithstanding any law, rule or regulation to the  contrary,
     5  a  general  hospital  whose  total  medicaid revenues resulting from the
     6  medicaid rates that took effect on December  first,  two  thousand  nine
     7  pursuant  to  this  subdivision have been reduced to such an extent that
     8  the hospital ranks among the top five percent of hospitals in  New  York
     9  state in terms of the percentage reduction in the hospital's total medi-
    10  caid  revenues, shall be entitled to receive an add-on to its rates that

    11  is equivalent to the incremental difference between uninsured  units  of
    12  services  and  cost  based  methodologies for the year two thousand nine
    13  indigent care pool. Such difference shall be divided  by  the  year  two
    14  thousand five fee-for-service discharges.
    15    (B)  Funds  in an amount totaling three million sixty thousand dollars
    16  shall be allocated pursuant to this section and shall be offset  in  the
    17  budget  neutrality  factor for the state-wide rates. The commissioner is
    18  hereby authorized and directed to adopt rules and regulations to  imple-
    19  ment the provisions of this section.
    20    § 2. This act shall take effect April 1, 2010, provided, however, that
    21  the  commissioner  of  health shall promulgate any rules and regulations

    22  necessary for the implementation of this act on or before such effective
    23  date.
