AN ACT to amend the education law, in relation to limitations upon
school district tax levies for certain school expenditures
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subparagraphs (iii) and (iv) of paragraph i of subdivision
2 2 of section 2023-a of the education law, as added by section 2 of part
3 A of chapter 97 of the laws of 2011, are amended and two new subpara-
4 graphs (v) and (vi) are added to read as follows:
5 (iii) in years in which the normal contribution rate of the New York
6 state teachers' retirement system, as defined by paragraph a of subdivi-
7 sion two of section five hundred seventeen of this chapter, increases by
8 more than two percentage points from the previous year, a tax levy
9 necessary for expenditures for the coming fiscal year for school
10 district employer contributions to the New York state teachers' retire-
11 ment system caused by growth in the normal contribution rate minus two
12 percentage points; [and]
13 (iv) a capital tax levy[.];
14 (v) a tax levy necessary for BOCES expenditures including a tax levy
15 necessary for BOCES capital and equipment expenditures; and
16 (vi) a tax levy necessary for school safety equipment expenditures.
17 § 2. This act shall take effect immediately; provided, however, that
18 the amendments made to section 2023-a of the education law made by
19 section one of this act shall not affect the repeal of such section and
20 shall be deemed repealed therewith.
