          Committee on Social Services
 
        AN ACT to amend the social services law, in relation  to  the  automatic
          reinstatement  of  public assistance following the completion of resi-
          dential drug treatment
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1. The social services law is amended by adding a new section
     2  131-y to read as follows:
     3    § 131-y. Automatic reinstatement of public  assistance  following  the
     4  completion of residential drug treatment. 1. Any individual who has been
     5  placed  in  a mandated residential treatment facility and has had his or
     6  her public assistance suspended as a result of such placement shall  not
     7  be  required  to  reapply  for public assistance when such placement has
     8  ended and shall be automatically reenrolled in both a cash and  non-cash
     9  public assistance program beginning on and after the day of release from
    10  such facility.
    11    2. Residential treatment facilities shall work in conjunction with the
    12  department  to  provide  the necessary services and assistance to ensure
    13  such individuals who require  the  reinstatement  of  public  assistance
    14  after  release  from a facility pursuant to this section are re-enrolled
    15  in cash and non-cash public assistance programs prior to  their  release
    16  from such facility.
    17    § 2. This act shall take effect immediately.
