        Introduced  by  M.  of  A.  PELLEGRINO  -- read once and referred to the
          Committee on Education
 
        AN ACT to amend the education law, in relation to confidentiality agree-
          ments with teachers
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section 1. Section 305 of the education law is amended by adding a new
     2  subdivision 57 to read as follows:
     3    57. a. Notwithstanding any law, rule or regulation to the contrary, no
     4  teacher, principal, or superintendent shall be required to sign a confi-
     5  dentiality  agreement  with  their  respective school district, board of
     6  cooperative educational services, or the department that  prevents  such
     7  teacher,  principal,  or  superintendent from discussing the contents of
     8  any ELA and math assessments in grades 3 through 8.
     9    b. The commissioner shall amend and/or modify  any  current  confiden-
    10  tiality  agreement to remove any provisions that prevent teachers, prin-
    11  cipals, or superintendents from discussing the contents of any  ELA  and
    12  math assessments in grades 3 through 8.
    13    § 2. This act shall take effect immediately.
