Go to top STATE OF NEW YORK ________________________________________________________________________ 10417 IN ASSEMBLY May 13, 2022 ___________ Introduced by COMMITTEE ON RULES -- (at request of M. of A. Thiele) -- read once and referred to the Committee on Local Governments AN ACT in relation to authorizing the county of Suffolk to convey by appropriate instruments to the Hampton Bays Water District, an ease- ment in Meschutt Beach County Park, for installation of a subaqueous water pipe crossing The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The county of Suffolk, acting by and through its governing 2 body, is hereby authorized to convey by appropriate instruments to the 3 Hampton Bays Water District, an easement in Meschutt Beach County Park 4 described in section three of this act, for installation of a subaqueous 5 water pipe crossing. 6 § 2. The authorization provided in section one of this act shall be 7 effective only upon the condition that the county of Suffolk dedicate an 8 amount equal to or greater than the fair market value of the easement 9 interest being alienated pursuant to section one of this act to the 10 acquisition of new parklands and/or capital improvements to existing 11 park and recreational facilities. 12 § 3. The easement to be conveyed by the county of Suffolk pursuant to 13 the provisions of this act is described as follows: 14 All that certain lot, piece of parcel of land situated and lying and 15 being at Shinnecock Hills, Town of Southampton, County of Suffolk and 16 State of New York, known and designated within District 900, Section189, 17 Block 2, Lot 001. Said parcel also known as "Meschutt Beach," being 18 specifically bound and described as follows: 19 BEGINNING at a point formed by the southerly right-of-way line of 20 Sunset Avenue and the easterly right-of-way line of Newtown Road. THENCE 21 running in an easterly direction, a distance of approximately 843 feet 22 along the southerly right-of-way line of Sunset Avenue to a point inter- 23 sected by the southerly right of-way line of Sunset Avenue and the 24 westerly boundary line of District 900, Section 188, Block 03, Lot 001. 25 THENCE from a point intersected by the southerly right-of-way line of 26 Sunset Avenue and the westerly boundary line of District 900, Section EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD15890-02-2A. 10417 2 1 188, Block 03, Lot 001 running in a northerly direction along the 2 westerly boundary line of District 900, Section 188, Block 03, Lot 001 a 3 distance of approximately 21 feet to a point. Said point being the POINT 4 OF BEGINNING. 5 From said POINT OF BEGINNING, running north along the westerly bounda- 6 ry line of District 900, Section 188, Block 03, Lot 1 a distance of 7 approximately 20 feet to a point located on the westerly boundary line 8 0f District 900, Section 188, Block 03, Lot 001. 9 THENCE, traveling in an easterly direction perpendicular to the water- 10 way known as the "Shinnecock Canal" a distance of approximately 142 feet 11 to a point located on the easterly boundary line of District 900, 12 Section 188, Block 03, Lot 001 and the westerly boundary line of 13 District 900, Section 189, Block 02, Lot 001. 14 THENCE running within the parcel designated as District 900, Section 15 189, Block 02, Lot 001 the following eleven (11) bearings and distances: 16 1. North 84°- 14'-29" East approximately 405 feet, 17 2. North 80°- 17'-43" West approximately 73 feet, 18 3. South 16°- 3'-15" East approximately 48 feet, 19 4. North 80°- 18'-37" West approximately 22 feet, 20 5. North 16°- 3'-15" West approximately 25 feet, 21 6. North 80°- 17'-43" West approximately 58 feet, 22 7. North 84°- 14'-29" West approximately 4 feet 23 8. South 5°- 45'-39" East approximately 21 feet, 24 9. South 84°- 14'-29" West approximately 20 feet, 25 10. North 5°- 45'-39" West approximately 21 feet, 26 11. South 84°- 14'-29" West approximately 375 feet, 27 To a point located on the easterly boundary line of District 900, 28 Section 188, Block 03, Lot 001 and the westerly boundary line of 29 District 900, Section 189, Block 02, Lot 001. 30 THENCE, traveling in a westerly direction perpendicular to the water- 31 way known as the "Shinnecock Canal" a distance of approximately 142 feet 32 to a point located on the westerly boundary line of District 900, 33 Section 188, Block 03, Lot 001. Said point being the aforementioned 34 POINT OF BEGINNING. 35 Containing approximately 13,393 square feet or 0.3 acres. 36 § 4. The conveyance of the easement authorized by the provisions of 37 this act shall not occur until the county of Suffolk has complied with 38 any federal requirements pertaining to the alienation or conversion of 39 parklands, including satisfying the secretary of the interior that the 40 alienation or conversion complies with all conditions which the secre- 41 tary of the interior deems necessary to assure that the substitution of 42 other lands be equivalent in fair market value and recreational useful- 43 ness to the lands being alienated or converted. 44 § 5. This act shall take effect immediately.
