AN ACT to amend the education law, in relation to providing financial
aid to certain school districts which provide half-day kindergarten
programs
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Paragraphs a and c of subdivision 9 of section 3602 of the
2 education law, paragraph a as amended by section 9 of part A of chapter
3 57 of the laws of 2013 and paragraph c as added by section 12 of part
4 CCC of chapter 59 of the laws of 2018, are amended to read as follows:
5 a. For aid payable in the two thousand seven--two thousand eight
6 school year and the two thousand seventeen--two thousand eighteen school
7 year and the two thousand twenty--two thousand twenty-one school year
8 and thereafter, school districts which provided any half-day kindergar-
9 ten programs or had no kindergarten programs in the nineteen hundred
10 ninety-six--ninety-seven school year and in the base year, and which
11 have not received an apportionment pursuant to this paragraph in any
12 prior school year, shall be eligible for aid equal to the product of the
13 district's selected foundation aid calculated pursuant to subdivision
14 four of this section multiplied by the positive difference resulting
15 when the full day kindergarten enrollment of children attending programs
16 in the district in the base year is subtracted from such enrollment in
17 the current year.
18 c. [Notwithstanding the provisions of paragraph a of this subdivision,
19 school] For aid payable in the two thousand eighteen--two thousand nine-
20 teen or two thousand nineteen--two thousand twenty school year, school
21 districts which provided any half-day kindergarten programs or had no
22 kindergarten programs in the nineteen hundred ninety-six--ninety-seven
23 school year and in the base year, and which have not received an appor-
24 tionment pursuant to this paragraph in any prior school year, shall be
25 eligible for aid equal to the product of the district's selected founda-
26 tion aid calculated pursuant to subdivision four of this section multi-
27 plied by the full day kindergarten enrollment of children attending

1 programs in the district in the base year. School districts receiving an
2 apportionment pursuant to [paragraph a of this subdivision in the two
3 thousand eighteen--two thousand nineteen or two thousand nineteen--two
4 thousand twenty school year] this paragraph shall be eligible for (A) an
5 apportionment in the following school year equal to the product of
6 sixty-five percent multiplied by the aid received by the district pursu-
7 ant to paragraph a of this subdivision in the prior school year, and (B)
8 an apportionment in the school year after the following year equal to
9 the product of thirty-five percent multiplied by the aid received by the
10 district pursuant to paragraph a of this subdivision in the year preced-
11 ing the prior year.
12 § 2. This act shall take effect on the same date and in the same
13 manner as section 12 of part CCC of chapter 59 of the laws of 2018,
14 takes effect.
