        AN ACT establishing a commission to determine the feasibility of forming
          a  State  Office  of  Water;  and  providing  for  the  repeal of such
          provisions upon expiration thereof
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  A temporary State commission, to be known as the New York
     2  State commission on establishing a State Office  of  Water,  hereinafter
     3  referred  to  as  "the  commission",  is hereby established to study the
     4  feasibility of establishing an Office of Water within the Department  of
     5  Environmental Conservation and transferring certain functions and duties
     6  currently  performed by the Department of Environmental Conservation and
     7  other State and local Departments to the Office of Water.
     8    § 2. (a) The commission shall  consist  of  thirteen  members,  to  be
     9  appointed as follows:
    10    (i) two members appointed by the Governor;
    11    (ii) two members appointed by the Temporary President of the Senate;
    12    (iii) two members appointed by the Speaker of the Assembly;
    13    (iv) one member appointed by the minority leader of the Senate;
    14    (v) one member appointed by the minority leader of the Assembly;
    15    (vi) the Commissioner of the Department of Environmental Conservation,
    16  or his or her designee;
    17    (vii)  the  Commissioner  of  the  Department of Health, or his or her
    18  designee;
    19    (viii) a Commissioner of the Public Service Commission or his  or  her
    20  designee;
    21    (ix) the Commissioner of Environmental Protection of New York City, or
    22  his or her designee; and
    23    (x)  the  Chair of the Water Resources Planning Council, or his or her
    24  designee.
    25    (b) Members of the commission shall serve for terms  of  three  years.
    26  Appointments  shall  be  made within sixty days of the effective date of
    27  this act. Vacancies on the commission shall  be  filled  in  the  manner

     1  provided  for  original appointments. Members may be re-appointed to the
     2  commission upon the expiration of their terms.
     3    (c)  All  members  of the commission shall have expertise in fields or
     4  disciplines related to water usage, management and/or safety,  including
     5  but not limited to:
     6    (i)  the  provision and delivery of water, including potable water, to
     7  residents of New York;
     8    (ii) water use and reuse, including standards for reuse  and  disposal
     9  of reclaimed wastewater;
    10    (iii) water quality testing;
    11    (iv)  the  protection  of  water  bodies, navigable waters, rivers and
    12  streams;
    13    (v) the protection of source water areas, groundwater areas and  aqui-
    14  fers; or
    15    (vi)  the  supervision and regulation of the sanitary aspects of water
    16  supplies and sewage disposal and control and the  prevention  and  miti-
    17  gation of pollution of waters of the State.
    18    (d)  The majority of the members of the entire commission shall desig-
    19  nate one member to serve as the chair of the commission and  one  member
    20  to serve as vice-chair of the commission.
    21    (e)  A  majority of the members of the commission then in office shall
    22  constitute a quorum for the transaction of business or the  exercise  of
    23  any  power or function of the commission. An act, determination or deci-
    24  sion of the majority of the members present during  the  presence  of  a
    25  quorum  shall  be  held to be the act, determination, or decision of the
    26  commission.
    27    (f) The commission shall meet at least quarterly at the  call  of  the
    28  chair.  Meetings may be held via teleconference. Special meetings may be
    29  called by the chair at the request of a majority of the members  of  the
    30  commission.
    31    (g)  Members of the commission shall receive no compensation for their
    32  services but shall be reimbursed for their actual expenses  incurred  in
    33  the performance of their duties in the work of the commission.
    34    § 3. The commission shall:
    35    (a) Study current laws, rules, and regulations pertaining to:
    36    (i)  the  current  provision of water to New York residents across the
    37  State;
    38    (ii) the protection of water sources across the State;
    39    (iii) the reduction of contaminants in State water sources; and
    40    (iv) the supervision and regulation of the sanitary aspects  of  water
    41  supplies  and  sewage  disposal and control and the prevention and miti-
    42  gation of pollution of waters of the State.
    43    (b) Analyze the current system of water distribution in various  areas
    44  of  the  State  including  the provision, the delivery and allocation of
    45  water, including potable water, to residents of New York, including  the
    46  efficiency  of and equality in the provision, and the delivery and allo-
    47  cation of such water;
    48    (c) Analyze the feasibility of establishing an Office of Water respon-
    49  sible for developing, overseeing and regulating a cohesive plan for  the
    50  provision  of  water,  including  potable water, to all residents of the
    51  State;
    52    (d) Analyze the financial impact on the state's finances of establish-
    53  ing an Office of Water and perform a fiscal  analysis  of  the  benefits
    54  associated  with  the creation of such Office including, but not limited
    55  to, cost savings, jobs created and jobs retained;

     1    (e) Provide recommendations for a transition  of  water-related  func-
     2  tions  currently  performed by the Department of Environmental Conserva-
     3  tion and the Department of Health to the proposed Office of Water; and
     4    (f)  Provide  a  legal  analysis  to  establish  an Office of Water in
     5  compliance with the New York State Constitution and state statutes.
     6    § 4. The commission may establish such advisory committees as it deems
     7  appropriate on matters relating to the  commission's  functions,  powers
     8  and  duties.  Such  committees  shall each be chaired by a member of the
     9  commission but may be composed of commission members as  well  as  other
    10  individuals  selected by the commission to provide expertise of interest
    11  specific to the charge of such committee.
    12    § 5. The  commission  may,  as  it  deems  appropriate,  request  that
    13  studies,  surveys,  or  analyses relating to the commission's powers and
    14  duties be performed by  any  State  Department,  commission,  agency  or
    15  public authority. All State Departments, commissions, agencies or public
    16  authorities  shall provide information and advice in a timely manner and
    17  otherwise assist the commission with its work.
    18    § 6. The Department of Environmental Conservation shall provide  staff
    19  services  to  the commission and such other administrative assistance as
    20  may be necessary for the commission to carry out its  duties,  functions
    21  and powers.
    22    §  7.  The  commission  shall hold a minimum of three public hearings:
    23  one in New York City; one in western New York; and one in upstate  east-
    24  ern  New  York.  The  commission  may hold additional public hearings in
    25  other locations as it deems appropriate.
    26    § 8. The commission shall make a preliminary report  to  the  Governor
    27  and  the  legislature  of its findings, conclusions, recommendations and
    28  activities already undertaken by the  commission,  not  later  than  six
    29  months after the effective date of this act and shall provide an updated
    30  report  every six months thereafter.  A final report of the commission's
    31  findings, conclusions, recommendations and activities already undertaken
    32  by the commission shall be provided to the Governor and the  legislature
    33  not later than two years after the delivery of the preliminary report.
    34    §  9.  This  act  shall take effect on the sixtieth day after it shall
    35  have become a law and shall expire six years after it shall have  become
    36  a  law  when  upon  such date the provisions of this act shall be deemed
    37  repealed.
