AN ACT to amend the labor law, in relation to personal protective equip-
ment standards for employers
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The labor law is amended by adding a new section 202-n to
2 read as follows:
3 § 202-n. Personal protective equipment standards. 1. All employers
4 shall provide their employees with access to surgical masks or respira-
5 tors, and disposable latex or nitrile gloves at no cost to such employ-
6 ees.
7 2. All employers shall maintain at least a one-month supply of surgi-
8 cal masks or respirators, and disposable latex or nitrile gloves, as
9 determined by the commissioner.
10 3. The commissioner shall promulgate such rules and regulations neces-
11 sary for the purposes of carrying out the provisions of this section.
12 § 2. This act shall take effect January 1, 2021. Effective immediate-
13 ly, the addition, amendment and/or repeal of any rule or regulation
14 necessary for the implementation of this act on its effective date are
15 authorized to be made and completed on or before such effective date.
