AN ACT to amend the criminal procedure law, in relation to the procedure
for reporting convictions of certain medical professionals
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 380.85 of the criminal procedure law, as added by
2 chapter 477 of the laws of 2008, is amended to read as follows:
3 § 380.85 Reporting sentences to office of professional medical conduct;
4 licensed physician, physician assistant, or specialist
5 assistant.
6 Whenever a person who is a licensed physician, physician assistant, or
7 specialist assistant or a physician who is practicing under a limited
8 permit or as a medical resident is [sentenced for] convicted of a crime,
9 the prosecutor shall file with the court, prior to sentencing, a notice
10 of the person's occupation along with a statement that such person is
11 subject to being reported to the office of professional medical conduct.
12 Following sentencing, the court that has sentenced such person shall
13 deliver a copy of the certificate of conviction and provide notification
14 of the conviction and sentence to the office of professional medical
15 conduct.
16 § 2. This act shall take effect immediately.
