AN ACT to amend the election law, in relation to casting and counting
absentee ballots without postmarked dates within three days following
the day of election
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 8-412 of the election law is amended by adding a
2 new subdivision 3 to read as follows:
3 3. Notwithstanding subdivision one of this section, in the event an
4 absentee ballot is received by mail by the board of elections in an
5 envelope that does not show a postmarked date of the United States
6 postal service, a cancellation mark of the United States postal service
7 or a foreign country's postal service, or a dated endorsement of receipt
8 by another agency of the United States government, and such absentee
9 ballot is received by mail by the board of elections not later than
10 three days following the day of election, such absentee ballot shall be
11 cast and counted.
12 § 2. This act shall take effect immediately.
