          read once and referred to the Committee on  Corporations,  Authorities
          and Commissions
 
        AN  ACT to amend the general business law, in relation to requiring cell
          towers to be equipped with a back-up power source in case of  a  power
          outage
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. The general business law is amended by adding a new section
     2  399-yyyy to read as follows:
     3    § 399-yyyy. Cellular network infrastructure; backup power. 1.    Every
     4  owner  or  operator  of  cellular network infrastructure located in this
     5  state shall equip all such cellular network infrastructure with an emer-
     6  gency back-up power source capable of providing adequate power to  main-
     7  tain  the  operation of such cellular network infrastructure in the case
     8  of a loss of power.
     9    2. For the purposes of this section, "cellular network infrastructure"
    10  shall mean any part of a radio telecommunications network that  provides
    11  wireless  communications  infrastructure  to  support  cellular  phones,
    12  located throughout a geographical  coverage  area,  including,  but  not
    13  limited to, cell towers.
    14    §  2.  This  act shall take effect on the ninetieth day after it shall
    15  have become a law.
