AN ACT to amend the education law, in relation to charter schools
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Paragraph (a) of subdivision 9-a of section 2852 of the
2 education law, as added by a chapter of the laws of 2010, amending the
3 education law relating to charter schools, as proposed in legislative
4 bills numbers S. 7990 and A. 11310, is amended to read as follows:
5 (a) The board of regents is hereby authorized and directed to issue
6 two hundred sixty charters pursuant to a competitive request for
7 proposals process.
8 (i) Commencing on August first, two thousand ten through September
9 first, two thousand thirteen, the board of regents and the board of
10 trustees of the state university of New York shall each issue a request
11 for proposals in accordance with this subdivision and this subparagraph:
12 (1) Each request for proposals to be issued by the board of regents
13 and the board of trustees of the state university of New York on August
14 first, two thousand ten shall be for a maximum of thirty-two charters to
15 be issued for charter schools which would commence instructional opera-
16 tion by the September of the next calendar year.
17 (2) Each request for proposals to be issued by the board of regents
18 and the board of trustees of the state university of New York on January
19 first, two thousand eleven shall be for a maximum of thirty-three char-
20 ters to be issued for charter schools which would commence instructional
21 operation by the September of the next calendar year.
22 (3) Each request for proposals to be issued by the board of regents
23 and the board of trustees of the state university of New York on January
24 first, two thousand twelve shall be for a maximum of thirty-two charters
25 to be issued for charter schools which would commence instructional
26 operation by the September of the next calendar year.
27 (4) Each request for proposals to be issued by the board of regents
28 and the board of trustees of the state university of New York on Septem-
29 ber first, two thousand thirteen shall be for a maximum of thirty-three

1 charters to be issued for charter schools which would commence instruc-
2 tional operation by the September of the next calendar year.
3 (ii) If after September first, two thousand thirteen, either the board
4 of regents or the board of trustees of the state university of New York
5 have any charters which have not yet been issued, they may be issued
6 pursuant to requests for proposals issued in each succeeding year, with-
7 out limitation as to when such requests for proposals may be issued, or
8 a limitation on the number of charters which may be issued.
9 (iii) Notwithstanding the provisions of clauses one, two, three and
10 four of subparagraph (i) of this paragraph and subparagraph (ii) of this
11 paragraph, if fewer charters are issued than were requested in [the]
12 such request for proposals, the difference may be added to the number of
13 charters requested in the request for proposals issued in [the] each
14 succeeding year.
15 [(iii)] (iv) The board of regents shall make a determination to issue
16 a charter pursuant to a request for proposals no later than December
17 thirty-first of each year.
18 § 2. This act shall take effect on the same date and in the same
19 manner as a chapter of the laws of 2010, amending the education law
20 relating to charter schools, as proposed in legislative bills numbers S.
21 7990 and A. 11310, takes effect.
