AN ACT to amend the civil service law, the public officers law and the
general municipal law, in relation to the employment by and funding of
the Nassau county public library system
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Legislative intent. This act seeks to enhance civil service
2 exemptions for library employees in the state of New York, recognizing
3 the unique challenges and contributions of libraries within their commu-
4 nities. It aims to provide greater flexibility in hiring, fair compen-
5 sation, and equitable funding for libraries.
6 § 2. The civil service law is amended by adding a new section 61-a to
7 read as follows:
8 § 61-a. Appointment and promotion; Nassau county public library
9 system. Notwithstanding the provisions of section fifty-one of this
10 article or section sixty-one of this title, the Nassau county public
11 library system is authorized to appoint or promote from an eligible list
12 to a position in the competitive class by the selection of one of the
13 five persons certified by the appropriate civil service commission as
14 standing highest on such eligible list who are willing to accept such
15 appointment or promotion.
16 § 3. Section 3 of the public officers law is amended by adding a new
17 subdivision 74 to read as follows:
18 74. In the county of Nassau, the provisions of this section requiring
19 a person to be a resident of the political subdivision or municipal
20 corporation of the state for which he or she shall be employed or within
21 which his or her official functions are required to be exercised, shall
22 not prevent a person from holding the office of Nassau county public
23 library system employee, provided that such person resides within the
24 state of New York.

1 § 4. Subparagraph (iv) of paragraph (g) of subdivision 2 of section
2 3-c of the general municipal law, as added by section 1 of part A of
3 chapter 97 of the laws of 2011, is amended and a new subparagraph (v) is
4 added to read as follows:
5 (iv) in years in which the normal contribution rate of the New York
6 state teachers' retirement system, as defined by paragraph a of subdivi-
7 sion two of section five hundred seventeen of the education law,
8 increases by more than two percentage points from the previous year, a
9 tax levy necessary for expenditures for the coming fiscal year for local
10 government employer contributions to the New York state teachers'
11 retirement system caused by growth in the normal contribution rate minus
12 two percentage points[.];
13 (v) a tax levy necessary for expenditures of the Nassau county public
14 library system.
15 § 5. Notwithstanding the provisions of section 273 of the education
16 law, any library that falls under the purview of a school district with-
17 in a county shall receive equal funding increases in allocation.
18 § 6. The department of education shall promulgate any rules and regu-
19 lations necessary for the implementation and enforcement of this act,
20 ensuring that the libraries have the necessary support and flexibility
21 to provide essential services to their communities.
22 § 7. This act shall take effect on the first of July next succeeding
23 the date on which it shall have become a law.
