AN ACT to amend the alcoholic beverage control law, in relation to
authorizing the manufacture of beer, spirits, cider, wine and mead at
the community college in Broome county and Cornell university, acting
on behalf of the New York state college of agriculture and life
sciences and the New York state agricultural experiment station
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Paragraphs (a), (c), (d) and (f) of subdivision 9 of
2 section 101 of the alcoholic beverage control law, as added by a chapter
3 of the laws of 2023 amending the alcoholic beverage control law relating
4 to authorizing the manufacture of beer, spirits, cider, wine and mead at
5 the community college in Broome county and Cornell university, acting on
6 behalf of the New York state college of agriculture and life sciences
7 and the New York state agricultural experiment station, as proposed in
8 legislative bills numbers S. 7085 and A. 7293, are amended to read as
9 follows:
10 (a) Notwithstanding any other provision of law to the contrary, the
11 state liquor authority shall issue a license under section
12 [seventy-six-a] sixty-one-a of this chapter to Cornell university on
13 behalf of the New York state college of agriculture and life sciences
14 and the New York state agricultural experiment station as defined in
15 sections fifty-seven hundred twelve and fifty-seven hundred thirteen of
16 the education law. Issuance of such a license shall not preclude or
17 nullify other licenses granted to Cornell university, whether now or in
18 the future, in all its locations in New York state in accordance with
19 the provisions of this chapter. Issuance of such a license shall not
20 restrict the ability of Cornell university, or the New York state
21 college of agriculture and life sciences and the New York state agricul-
22 tural experiment station to conduct research, teaching, education,
23 extension and outreach, and economic development activities related to
24 products that are not regulated by this chapter. For purposes of
25 compliance with this chapter, the New York state college of agriculture

1 and life sciences and the New York state agricultural experiment station
2 as defined in sections fifty-seven hundred twelve and fifty-seven
3 hundred thirteen of the education law shall be considered to be located
4 on a farm.
5 (c) No person shall be disqualified from acting as a director, advi-
6 sory council member, officer, or employee of, or purveyor to, Cornell
7 university and the New York state college of agriculture and life
8 sciences and the New York state agricultural experiment station by
9 reason of such person holding a license under this [subdivision]
10 chapter, or being affiliated with a licensee under this [subdivision]
11 chapter as a shareholder, partner, officer, director, or employee.
12 (d) No person shall be disqualified from being a donor, patron,
13 contributor or sponsor from time to time of Cornell university and the
14 New York state college of agriculture and life sciences and the New York
15 state agricultural experiment station through contributions in cash or
16 in kind, by reason of such person holding a license under this [subdivi-
17 sion] chapter, or being affiliated with a licensee under this [subdivi-
18 sion] chapter as a shareholder, partner, officer, director, or employee.
19 (f) Notwithstanding any other provision of law to the contrary,
20 Cornell university may: (i) offer educational courses, workshops or
21 other instructional events on wine, distilled spirits, cider, mead, beer
22 and other fermented products through any of its colleges, schools or
23 units, in accordance with internally established fee schedules and under
24 appropriate licenses; and (ii) [authorize the use of its facilities for
25 conferences and events from time to time, including by other entities
26 and by the general public, in accordance with internally established fee
27 schedules and may sell and serve, or authorize others to sell and serve,
28 at such events wines, beers, ciders, meads, distilled spirits and other
29 fermented products under appropriate licenses] use its facilities, and
30 provide the use of its facilities to third parties, for functions at
31 which alcoholic beverages may be sold and served provided the university
32 or third parties, as applicable, have obtained the appropriate permit or
33 license from the authority.
34 § 2. The opening paragraph of paragraph (a) and paragraphs (b), (c)
35 and (d) of subdivision 10 of section 101 of the alcoholic beverage
36 control law, as added by a chapter of the laws of 2023 amending the
37 alcoholic beverage control law relating to authorizing the manufacture
38 of beer, spirits, cider, wine and mead at the community college in
39 Broome county and Cornell university, acting on behalf of the New York
40 state college of agriculture and life sciences and the New York state
41 agricultural experiment station, as proposed in legislative bills
42 numbers S. 7085 and A. 7293, are amended and a new paragraph (f) is
43 added to read as follows:
44 Notwithstanding any other provision of law to the contrary, the state
45 liquor authority shall issue a license under section [seventy-six-a]
46 sixty-one-a of this chapter to the community college in Broome county,
47 established pursuant to article one hundred twenty-six of the education
48 law, in the city of Binghamton, and the Broome county culinary and
49 events center on the premises described as follows:
50 (b) The community college in Broome county and Broome county culinary
51 and events center may, but shall not be required to, produce wine, beer,
52 [distillates] distilled spirits, cider and mead as a condition of such
53 license.
54 (c) No person shall be disqualified from acting as a director, advi-
55 sory council member, officer, or employee of, or purveyor to, the commu-
56 nity college in Broome county and Broome county culinary and events

1 center by reason of such person holding a license under this [subdivi-
2 sion] chapter, or being affiliated with a licensee under this [subdivi-
3 sion] chapter as a shareholder, partner, officer, director, or employee.
4 (d) No person shall be disqualified from being a donor, patron,
5 contributor or sponsor from time to time of the community college in
6 Broome county and Broome county culinary and events center through
7 contributions in cash or in kind, by reason of such person holding a
8 license under this [subdivision] chapter, or being affiliated with a
9 licensee under this [subdivision] chapter as a shareholder, partner,
10 officer, director, or employee.
11 (f) For purposes of compliance with this chapter, the community
12 college in Broome county and the Broome county culinary and events
13 center shall be considered to be located on a farm.
14 § 3. This act shall take effect on the same date and in the same
15 manner as a chapter of the laws of 2023 amending the alcoholic beverage
16 control law relating to authorizing the manufacture of beer, spirits,
17 cider, wine and mead at the community college in Broome county and
18 Cornell university, acting on behalf of the New York state college of
19 agriculture and life sciences and the New York state agricultural exper-
20 iment station, as proposed in legislative bills numbers S. 7085 and A.
21 7293, takes effect.
