        AN  ACT  to  amend  the  environmental  conservation law, in relation to
          prohibiting the use of the chemicals atrazine, metalaxyl and the neon-
          icotinoids class of chemicals
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  The environmental conservation law is amended by adding a
     2  new section 37-0115 to read as follows:
     3  § 37-0115. Prohibition of use of the chemicals  atrazine,  metalaxyl  or
     4               the neonicotinoids class of chemicals.
     5    It  shall  be  unlawful  for any person to distribute, sell, offer for
     6  sale or use the chemicals atrazine, metalaxyl or the class of  chemicals
     7  neonicotinoids,  including  imidacloprid, clothianidin and thiamethoxam,
     8  within this state or deliver for transportation or transport  in  intra-
     9  state  commerce  or  between  points within this state through any point
    10  outside this state.
    11    § 2. This act shall take effect January 1,  2019;  provided,  however,
    12  that  effective  immediately,  the addition and/or repeal of any rule or
    13  regulation necessary for the implementation of this act on its effective
    14  date are authorized and directed to be made and completed on  or  before
    15  such effective date.
