        Introduced  by  Sen. MORAHAN -- read twice and ordered printed, and when
          printed to be committed to the Committee on Codes
 
        AN ACT to amend the penal law, in relation to designating as a  class  E
          felony,  the  offense  of endangering the welfare of an incompetent or
          physically disabled person
 

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1. Section 260.25 of the penal law, as amended by chapter 381
     2  of the laws of 1998, is amended to read as follows:
     3  § 260.25  Endangering the welfare of an incompetent or physically  disa-
     4               bled person.
     5    A  person  is  guilty  of endangering the welfare of an incompetent or
     6  physically disabled person when he or she knowingly  acts  in  a  manner
     7  likely  to  be  injurious  to the physical, mental or moral welfare of a
     8  person who is unable to care for himself or herself because of  physical
     9  disability, mental disease or defect.
    10    Endangering  the  welfare  of  an  incompetent  or physically disabled
    11  person is a class [A misdemeanor] E felony.

    12    § 2. This act shall take effect on the first of November next succeed-
    13  ing the date on which it shall have become a law.
