        Introduced  by  Sen. PERALTA -- read twice and ordered printed, and when
          printed to be committed  to  the  Committee  on  Cities  --  committee
          discharged, bill amended, ordered reprinted as amended and recommitted
          to  said  committee -- reported favorably from said committee, ordered
          to first and second report, ordered to a third  reading,  amended  and
          ordered reprinted, retaining its place in the order of third reading
 
        AN  ACT  to  amend  the  administrative code of the city of New York, in
          relation to directing the department of transportation of the city  of
          New  York  to  study  and report on its current and planned efforts to
          educate pedestrians and drivers relating  to  being  distracted  while
          using a mobile device; and providing for the repeal of such provisions
          upon expiration thereof
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. The administrative code of the city of New York is  amended
     2  by adding a new section 19-197 to read as follows:
     3    §  19-197  Department report on distracted pedestrians. The department
     4  shall study and produce a  report  regarding  its  current  and  planned
     5  efforts to educate pedestrians and drivers of:
     6    1.  the dangers inherent in acting as a pedestrian while distracted by
     7  texting, or other uses of a mobile device; and
     8    2. the necessity of operators of motor vehicles to  exercise  care  in
     9  watching for pedestrians who are distracted by texting, or other uses of
    10  a  mobile  device,  regardless  of  whether  a pedestrian is utilizing a
    11  defined street crossing.
    12    Such study and report shall detail the department's communications, on
    13  a citywide basis, that educate pedestrians about the dangers of using  a
    14  mobile device while traversing an intersection, and the dangers of using
    15  a  mobile  device  while  being near or in a street and shall provide an
    16  analysis of the effectiveness of such communications. The  report  shall

     1  further  provide  recommendations  relative  to  preventing future motor
     2  vehicle crashes involving pedestrians who are utilizing a mobile device.
     3  The department shall submit its report to the  governor,  the  temporary
     4  president  of the senate, the speaker of the assembly, the mayor and the
     5  speaker of the city council.
     6    § 2. This act shall take effect immediately and shall  expire  and  be
     7  deemed repealed following the submission of the report required pursuant
     8  to section 19-197 of the administrative code of the city of New York, as
     9  added by section one of this act; provided that the department of trans-
    10  portation  of  the  city  of  New York shall notify the legislative bill
    11  drafting commission upon  the  submission  of  the  report  required  by
    12  section  19-197  of  the administrative code of the city of New York, as
    13  added by section one of this act, in order that the commission may main-
    14  tain an accurate and timely effective data base of the official text  of
    15  the  laws  of  the  state of New York in furtherance of effectuating the
    16  provisions of section 44 of the legislative law and section 70-b of  the
    17  public officers law.
